11/17/2014 State.co.us Executive Branch Mail - Fwd: Request for a formal Board Hearing on MWNW, MW23 and lack of permitting by EFCI
also understand your concern about deadlines. At this point, there are no decision deadlines in process.
Regarding any NOV related deadlines, I am working with our attorney as it is rather unusual for a third party
(someone other than the recipient of an enforcement action) to request a hearing. I will keep you apprised as to
any options or deadlines. It is my hope that with some discussion, we can better understand and resolve the
issues without a hearing.
have also advised EFCI that we are communicating.
Thank you again,
David
On Wed, Apr 16, 2014 at 3:34 PM, Linda Saunders <saunders615 live.com> wrote:
Dave,
Thank you for getting back to me.
would suggest a conference call with all the property owners next week. I will email them- Paula and Ted
Coulter and Tena Gallagher. I will email them and see when they are available. Ted has a phone number to
call and we can all call in at the specified time.
My concern is that we will miss a deadline to reply to any decision.
Also I would like you to explain how MWNW can monitor the mine working which it is intended to do. The roof
fall or heave has damaged the pipe and the 2X4X8 piece of wood that blocks the pipe 18 inches above the
mine workings. Therefore, I do not see how it can determine if there is water in the mine workings.
will let you know if everyone is available at the same time next week. I will try to work it out around 4:30. We
usually talk around 6pm.
Linda
Date: Wed, 16 Apr 2014 14:31:31 -0600
Subject: Re: Request for a formal Board Hearing on MWNW, MW23 and lack of permitting by EFCI
From: david.berry@state.co.us
To: saunders6l5@live.com
CC: rob.zuber@state.co.us; daniel.hernandez@state.co.us; tena @aol.com
It would be helpful if we could talk about the issues discussed in your letter. Of particular note is the concern
that the MWNW would no longer be monitored. Although we have modified the NOV to allow a demonstration
that the well can still be used, we have yet to receive and review any new information. The NOV is still
pending.
Might there be a time early next week that we could talk by phone so that I can better understand your
concerns?
Thank you,
David Berry
Director, Coal Regulatory Program
On Thu, Apr 10, 2014 at 1:48 PM, Linda Saunders <saunders615 @live.com> wrote:
TO: Division of Reclamation, Mining and Safety Staff and Board
From: K2T LLC, Linda Saunders, manager and owner and Tena
Gallager, owner
hftps://mail.google.com/mail/u/0/?ui=2&ik=e29129fcb5&vi ew =pt &search= i nbox &th= 149bec9da1631 cc4 &si m 1= 149bec9da1631 cc4 2/3
