Transportation loss charges, if <br />applicable, will be as assessed by the water commissioner. <br />Replacement for depletions during the period of September through April and at times when <br />the Barnes Ditch inches are out -of- priority will be met by releases of fully consumable water leased <br />from the City of Loveland. LRM has a total of 200 acre -feet of fully consumable water available <br />pursuant to a lease agreement dated January 13, 1998. The subject lease is valid for a term of 25 <br />years, ending on December 31, 2022. For the approval period of this plan, LRM has dedicated 100.66 <br />acre -feet to the augmentation plan decreed in case no. 2009CW105, and has up to 99 acre -feet <br />available for use under this SWSP. Delivery of the leased water will take place at Loveland's <br />wastewater treatment plant (WDID 0402300), or at another location agreed upon by Loveland and <br />LRM. <br />A monthly breakdown of the stream depletions and replacements are shown in the attached <br />Table 6. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with § 37 -90- 137(11), <br />C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2014 through October 31, 2015 unless <br />otherwise revoked, modified, or superseded by decree. If operation under this SWSP will be <br />required for an additional period, a renewal request must be submitted to this office with the <br />statutory fee (currently $257 for each mining site) prior to the expiration date but no later <br />than August 31, 2015. <br />2. Well permits have been obtained in accordance with § 37 -90- 137(2) and (11), C.R.S., for the <br />current use and exposed water surface area of each gravel pit, as identified in Table A. <br />3. The total area of pond surface exposed after December 31, 1980 shall not exceed 40.56 acres <br />at the Larimer Pit, 2.81 acres at the Mariana Butte Pit, and 17.2 acres at the Baer Pit, as <br />shown in Table A of this approval. Should the total surface area exposed exceed those <br />amounts, an amendment to this plan will need to be filed with this office. <br />4. The total amount of ground water to be appropriated from each of the pits shall not exceed <br />the values listed in Table B of this approval. Total consumption must not exceed these <br />aforementioned amounts unless an amendment is made to this plan. <br />5. Approval of this plan is for the purposes as stated herein. Any additional uses of water must <br />first be approved by this office. Any future additional historical consumptive,use credit given <br />(e.g., agricultural water transfer) for this site must consider all previous credits given. <br />6. All releases of replacement water must be sufficient to cover all out -of- priority depletions in <br />time, place, and amount and must be made under the direction and /or the approval of the <br />water commissioner. The release of replacement water may be aggregated to maximize <br />beneficial use. The water commissioner and /or the division engineer shall determine the rate <br />and timing of an aggregated release. <br />
