INTEROFFICE MEMORANDUM <br />TO: <br />ZACK TRUJILLO <br />FROM: <br />JANET BINNS <br />SUBJECT: <br />MUNGER CANYON MINE, SL2 VEGETATION REVIEW <br />DATE: <br />10/30/2014 <br />CC: <br />MIKE BOULAY <br />I have reviewed the Munger Canyon Mine application for a Phase II bond release for the <br />reclaimed portions of the haul roads and access road, and a Phase II and III bond release for 2.9 <br />acres at the Loma load out. <br />The vegetation sampling reports were submitted separately for the mine area reclamation and the <br />reclaimed load out. The vegetation report for the mine area reclamation was previously <br />submitted with technical revision No. 25, and incorporated into Table 4.08 -35. Reclamation <br />success standards can be found in Section 3.9 (page3 -21) of the permit. The 2013 Vegetation <br />Report for the Loma load out was submitted September 3, 2014 as part of SL2. <br />The Loma load out was disturbed prior to permitting as coal load out. As such no topsoil was <br />salvaged at the load out site. The pre- mining land use at the load out was industrial and the post - <br />mining land use is approved as industrial. The reclamation requirements for the load out are <br />defined by Rule 4.15.10(2). Vegetation establishment at the Loma load out is not required to be <br />compared to a reference area. The Loma load out property is owned by Union Pacific Railroad <br />(Figure 1.1 -3A). <br />Vegetation at the mine site and the sagebrush reference area was sampled in May 29, 2013. <br />Vegetation at the Loma load out was sampled on June 1, 2013. The 2013 Vegetation Report for <br />the reclamation at the mine site was submitted April 4, 2014 as part of TR25. Reclaimed areas at <br />the mine site were compared to the Sagebrush Reference Area for cover and productivity criteria. <br />Woody plant density and species diversity success criteria are defined in the permit. Results <br />from the April 4, 2014 201 Vegetation Report submittal (TR25) are attached to this memo with <br />the memo for TR25. <br />The Loma Load out Salt Tolerant seed mix was used for the load out. The load out was graded <br />and seeded in 2001. Due to poor initial stand establishment at the load out, the site was reseeded <br />in November 2004. Sampling in 2013 represents the ninth growing season following reseeding. <br />Rule 3.02.3(2)(c) allows for less than the ten year period of liability (Rule 3.02.3(2)(b)) if the <br />permittee demonstrates that the development of the post- mining industrial land use has <br />commenced, and that the vegetation requirement of Rule4.15.10(2) has been achieved. <br />
