Please note the following: <br />1. Hydrologic Balance /Monitoring As I have noted to you already, I am scheduled to put <br />down these three wells in the approved locations on 10- 28 -14. The corrective action due date <br />is 10- 31 -14, but the intent for the wells was to get baseline data for at least a year prior to the <br />start of backfilling of the shale in any area nearby to where the wells are to be located <br />(related to mounding and shadowing of nearby neighbors). Any backfill will start in the far <br />northern area of the current location for mining, well north of the Schell residence. The <br />groundwater flow direction is SE to the NW, and mounding would not occur in this northern <br />area at the time of backfill that would affect the Schell residence. The other two locations <br />near to the potentially affected neighbors are far to the south and southwest and will not be <br />mined/backfilled for some years to come. Please see Attachment I for an approved Notice of <br />Intent to Construct Monitoring Holes from the State Water Resources Dept. I will copy the <br />DRMS on the monitoring well permits from the Water Resources Dept. once they have been <br />approved. <br />2. Compliance with Mine Plan: The corrective action due date for this topic is 12- 31 -14. A <br />technical revision will be submitted to the DRMS by 12 -31 -14 addressing changes to the <br />mine plan showing areas of new mining due to the removal of oil and gas wells and flowlines <br />and re- mining of a small area in the central portion of the permit site due to the floods of <br />September 2013 and Boulder Cr. jumping its banks into the mine site. These are slight <br />changes, but will present a more correct and up -to -date version of the mine plan. Any <br />increase or decrease in bonding will also be rectified. With regard to the importation of <br />materials (hardened asphalt and concrete chunks) into the site for recycling and that activity <br />not being a part of the mine plan, this topic will also be addressed in the TR. We have <br />scheduled a meeting with Weld County to propose these activities on this site and to see what <br />
