DNR <br />CO <br />October 27, 2014 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Mr. Brian Watterson <br />Moffat County Mining, LLC <br />29515 Routt County Road 927 <br />Oak Creek, CO 80467 <br />RE: Williams Fork Mines; Permit No. C- 1981 -044 <br />3'd Quarter 2014 Refuse Pile Inspection Report Review <br />Dear Mr. Watterson, <br />The Colorado Division of Reclamation, Mining and Safety (Division) finds the above referenced refuse <br />pile inspection report for the 3rd Quarter 2014 to be in compliance with the following rules: <br />4.10.2(1) — The mine waste bank was inspected, on behalf of the person conducting surface coal <br />mining operations, by a qualified registered engineer, or other qualified professional specialist. <br />• The report is signed by you, a geologist. <br />• The report indicates no materials were placed on the surface waste pile; also the <br />99 excavation waste disposal area was reclaimed in 2009. <br />4.10.2(2) <br />• The submitted inspection report complies with the inspection requirement of rule <br />4.09.1(11). <br />■ (a) The fill was inspected quarterly. <br />■ (b) The report indicated the stability of the fills was inspected and no <br />appearances of instability, structural weakness or other hazardous conditions <br />were noted. The inspection was conducted on September 19, 2014 and the report <br />was dated October 3, 2014. However, the Division did not receive the report <br />until October 10, 2014. The Division request that the operator submit the report <br />so that the Division will receive it within the required two week time frame <br />outlined in Rule 4.09.1(11)(c). <br />■ (c) An underdrain system or protective filters were not reported to have been <br />installed during this quarter. <br />• (a) — The inspection occurred quarterly as required by the Division. <br />• (b) — The stability of the fills was inspected. It does not appear tests were necessary to <br />evaluate the potential hazard to human life and property. <br />■ The note on the submitted report indicates that the mine has been inactive since <br />1995 and that no material has been placed on the surface waste pile. Also noted <br />was that the old 99 excavation was reclaimed with demolition material in early <br />2009. Stability of the waste disposal areas was inspected and problems were not <br />identified.
