10/23/2014 State.co.us Executive Branch Mail - Mitigation Request - Water Accumulation - South Portal Roadside Mine <br />Aft STATE OF <br />IMFC <br />OLORADO Berry - DNR, David <david.berry@state.co.us> <br />Mitigation Request - Water Accumulation - South Portal Roadside Mine <br />1 message <br />Berry - DNR, David <david.berry@state.co.us> Tue, Jun 17, 2014 at 6:01 PM <br />To: tonya.snowcap @bresnan.net <br />Cc: David Berry <david.berry@state.co.us >, Mike Boulay - DNR <mike.boulay @state.co.us >, Daniel Hernandez - <br />DNR <daniel.hernandez @ state.co.us> <br />Hello Tonya - I write to request the assistance of Snowcap Coal Co., Inc with mitigation of an apparently <br />hazardous situation at the South Portal (Roadside Mine). <br />It is my understanding, that our inspection of today indicates that water is accumulating behind the previously <br />closed South Portal location, which water is expressing from the underdrains at an accelerated rate and volume, <br />and which water is expressing from the surrounding in -situ geology. <br />We understand that this water may be originating from surface water application by Mr. Fontanari occurring <br />above the mine, and we have notified him of the situation. It is our understanding that the Mr. Fontanari will stop <br />the surface water application tomorrow. <br />Given the apparent accumulation of water behind the mine closure, and within the surrounding landscape, and <br />given the proximity of this situation to an adjacent business and 1 -70, we are concerned that immediate action <br />should be taken to mitigate the potential for a serious human health and safety risk. <br />DRMS requests that Snowcap Coal Co., Inc. take the following actions as soon as safely possible: <br />1. Mobilize the appropriate equipment to safely open the mine closure to drain the water now accumulating <br />behind the mine seals. Please only conduct this operation in a manner that ensures the safety of mine <br />employees, the equipment operator(s) and any other persons or property that may be placed at risk by the <br />operation. <br />2. Continue to manage the water discharge in compliance with the NPDES permit(s) for the site. <br />3. Remain in contact with the Mr. Fontanari to be sure that the surface water source is terminated as soon as <br />possible. <br />4. Closely monitor the situation now and until the potential hazard is mitigated, to assess the risk of potential <br />catastrophic failure, and implement appropriate notifications to DRMS and adjacent entities such as CDOT and <br />the fruit vendor if there is an imminent risk to adjacent property or human health and safety. <br />DRMS understands that this location was previously bond released, but we are asking that Snowcap take this <br />immediate action to alleviate any potential for property damage or any risk to human health and safety, <br />potentially resulting from this developing situation.
