10/22/2014 <br />State.co.us Executive Branch Mail - RE: Schedule for Response <br />EFCI appreciates the efforts of the Division in facilitating the proposed meeting and we believe an opportunity to <br />discuss the concerns related to MW -NW will be useful and we will be prepared on Friday to discuss those issues. I <br />believe all the reports prepared by the groundwater consultants related to groundwater issues are on file with the <br />Division. We will verify that prior to Friday. <br />Given the travel schedule etc., I am not able to respond now in writing to all the matters raised in the April <br />emailed letter. We can prepare such a response but not by noon today. <br />With regard to the original mining lease and its assignment to EFCI, as Ms. Gallagher knows, that lease was <br />replaced in its entirety in the year 2000 by a new Coal Mining Lease. The new Lease was part of the settlement of <br />a lawsuit brought against EFCI by K2T LLC and others which resulted in payments being made to the plaintiffs by <br />EFCI in settlement of all issues related to the original lease. A formal Release and Settlement Agreement was <br />signed by all parties. <br />We are still prepared to attend the meeting on Friday. <br />Regards, Rich Munson <br />Rich A.
