TR-07 MINING PLAN
Specific Restrictions on Mining Locations
Several sections of this portion of the original plan have been removed in TR-07 because they are
no longer relevant to the plan.
REQUIREMENT 3: No mining or other disturbance that will disrupt the surface of the land can
occur within 200 feet of existing gas or oil wells, oil or gas pipelines, or water wells or waterlines.
Affecting land closer than 200 feet is only allowed after permission is obtained from the well or pipeline
owner and the additional disturbance is also approved by the Colorado State Board of Land
Commissioners and the Division of Reclamation, Mining and Safety(or Mined Land Reclamation Board).
This also applies to overhead power lines with respect to mining but not necessarily other uses of the
land in the mining operation. Driving over buried pipelines (oil, gas, or water)will be allowed on
established roadways. In the event temporary access roads must be created that cross a buried line,
confirmation that driving over the pipeline is safe will be obtained prior to using the access route. Safety
with respect to crossing under overhead lines will always be observed. Soil/overburden stockpiles shall not
be placed on top of buried pipelines.
Oil and Gas Well Setbacks and Utility Setbacks-
REQUIREMENT 4: When anew oil or gas well or other facility, including any oil and gas
pipeline, is established within the permit area it is important to remove from the permit the land affected
by that facility, provided that land will not be used in the future by the mine operator. To accomplish this
removal a prior technical revision provided a process to legally remove that land from the permit and any
obligation by the operator. It is customary for oil and gas lessees to inquire as to whether a new facility
will affect the mining operation and it is customary to not establish such facilities on land that is being
reclaimed until such time as the land is reclaimed and released.
Overview of Mine Plan
General direction of mining: REQUIREMENT 5-
Upland Mining TR-07: Upland mining is the only type of mining contained in the plan.
The existing mining area was established in compliance with this former set of requirements.
Therefore, distinguishing "upland mining" is no longer useful or relevant.
Lowland Mining TR-07. All lowland mining areas have been removed from the plan.
Coal Creek Sand Resource Amendment 3 (2005)- M-1988-044 Exhibit D Page 8
