Box 247 <br /> Cripple Creek, CO 80813 <br /> RE: Mineral Mountain Gold,LLC.,Mineral Mountain Project,File No.M-2014-045; <br /> Second Adequacy Review <br /> Dear Mr. Barker: <br /> The Division of Reclamation, Mining and Safety (Division) has completed its second adequacy review of <br /> Braun Environmental's response to the Division's September 8, 2014 Preliminary Adequacy Review. Due <br /> to the permit overlapping with M-2006-064, and the Division's concern over whether this project is subject <br /> to designated mining operation (DMO) status, the application was determined to be complex on September <br /> 17, 2014 and 60 days were added to the decision date. The decision date for this application is now <br /> November 16, 2014. Please be advised that if you are unable to satisfactorily address any concerns identified <br /> in this review before the decision date, it will be your responsibility to request an extension of the review <br /> period. If there are outstanding issues that have not been adequately addressed prior to the end of the review <br /> period,and no extension has been requested,the Division will deny this application. <br /> DETERMINATION OF DESIGNATED MINING OPERATION(DMO)STATUS <br /> The Division's determination of DMO status was based on review of the Acid Rock Report from <br /> Braun Envirionmental, Inc., dated September 24, 2014. Please refer to Comment 3 below for <br /> instructions on how to address this issue. <br /> The original comment numbers from the preliminary adequacy review have been retained for the purpose of <br /> tracking responses. <br /> APPLICATION <br /> 1. Item 3, Permitted Acreage — The response is adequate. The Division will use the intended 9.35 <br /> acres for the permit area. However, the Division noted that the permit boundary has no legal <br /> description. Please provide metes and bounds, coordinates for the corners or some other means by <br /> which the boundary can be reproduced. <br /> 2. Item 10, Location Information—The response is adequate. <br /> 3. Item 14, toxic materials/acid mine drainage — The Division has reviewed the Acid Rock Report <br /> from Braun Environmental, Inc., dated September 24, 2014 and found that DMO status is <br /> appropriate for the Mineral Mountain Project (see attached Memo from Tom Kaldenbach to Tim <br /> Cazier, dated October 16, 2014).
