STATE HIGHWAY ACCESS PERMIT #399055 June 7, 199 <br />Issued to Bowie Resources. Inc. <br />TERMS & CONDITIONS <br />1. This permit is issued in conjunction with Permits Ns 399056 and Ns 399057. Submittal for design shall include <br />considerations for all of these permits. (only one submittal required) If there are any questions regarding this <br />permit, please contact Mike Smith at (9701'_48-7?31. - <br />?. The Permittee shall design and submit for approval a left turn deceleration and acceleration lane 16 fee[ in width in <br />conformance with section 4 0(the Slate Highway Access Code. 2CCR 601 <br />3. The Permittee shall design and submit for approval a right turn deceleration and acceleration lane 12 feet in width <br />in conformance with section 4 of the Slate Highway Access Code, 2CCR 601-1. <br />4. Design of this access with auxiliary lanes shall include, at a minimum, 1 [h-inch overlay. <br />5. A Notice to Proceed, CDOT Form 1265 is required before beginning the conswction of [he access or any activity <br />within the highway righ[-of-way. All submittals, documents, plans and other items that must be completed, shall <br />be submitted and approved before a Notice to Proceed will be issued. Contact the Department (or local issuing <br />authority) for [he Notice to Proceed. <br />6. The following items are required before a Notice to Proceed will be issued: <br />(a) Construction Plans Stamped by a Colorado Registered Professional Engineer. <br />(b) Certificate of Insurance Liability as per Section 2.3(11)(h) of the Access Code. <br />(c) Traffic Control Plan <br />7. The Permittee shall refer to ail additional standazd requirements on the back of this permit and any enclosed <br />additional terms, conditions, exhibits and no[ed attachments. <br />8. This Permit is issued in accordance with the State Highway Access Code (2 CCR 60t-I), and is based in part upo~ <br />the information submitted by the Permittee. This permit is only for the use and purpose stated in the Application <br />and Permit. Any changes in vaffic volumes or type, drainage, or other operational aspects may render this permtt <br />void. requiring a new permit to be applied for based upon existing and anticipated future conditions. <br />9. Nothing in this permit shall prohibit the chief engineer from exercising the right granted in CRS 43-3-102 <br />Including but no[ limited [o restricting left hand turns by construction of physical medial sepazations. <br />11. All costs associated with [he installation of vaffic tights for this access are the responsibility of the Permittee. This <br />includes but is not limited to the design, construction, utility relocation. testine of materials and inspection. <br />12. Wa[er, sanitary. sewer. gas, elecvical. communication, landscaping, and telephone installations will require <br />individual additional permits. <br />13. The Permittee is responsible for obtainins any necessary additional federal, state and/or Ciry/Courtly permits or <br />cleazances required for construction of the access. Approval of this access permit does not constitute verification <br />of this action by the Permittee. <br />14. Any work within State Highway right-of-way shall begin after 8:30 A.M. and all work and equipment shall be off <br />the highway BEFORE 3:30 P.M. each day. <br />I5. No highway lane closures or one-wa}• traffic will be allowed. <br />16. No work will bz allowed at night. Saturda}~s. Sundays and legal holidays without prior authorization from the <br />Department. The Department may also resvict work within the State Highway right-of-wa)• during adverse <br />weather conditions. - <br />
