PART t Page No. 3 Permit No. COG•850000 A. COVERAGE UNDER THIS PERMIT • 1. This general pemrit authorizes discharges that consist entirely or principally of precipitation-induced surface runoff from acid or ferruginous coal mining and processing operations including loadouts, while active mining is occurring or during reclamation prior to final bond release, to land (as dust control), and into waters of the State of Colorado. If additional sources which the Division determines to be minor in nature such as selected mine water, prepazation plant water, spoils spring water, runoff through refuse piles, or other wastewater may be discharged. These sources may be covered under this permit at the Division's discretion, providing that such wastewater would not require effluent limitations and/or monitoring requirements other than those contained in this permit. Such determinations will be made on a case-by case basis upon review of the permit application and any additional relevant information. This permit does not cover underground mining. If dischazge from one or more of the above listed sources require additional limitations and/or monitoring requirements, an individual permit maybe required. Multiple dischazge points from one facility maybe authorized through this pemrit providing all meet these criteria. 2. In order to apply for certification under this general permit, the owner, operator, and/or authorized agent of the subject facility shall submit by certified mail or hand delivery, the completed Coal Mining Wastewater Dischazge Application_(fumished bythe Division) which generally requires the following information (at a minimum): a. ame, a ess, an escnphve ocahon o e ac t ; b. Name of principal in chazge of operation of the facility; c. Name of immediate receiving waters, (including irrigation ditches, intermittent streams and dry drainage, as applicable); d. Description of the type of activity(ies) resulting is the discharge, including the anticipated duration of the activity and/or the discharge, anticipated volume and rate of discLazge, and the source(s) of water to be dtschazged; e. Description of any wastewater treatment system(s) and recycle/reuse utilized; f. An 8 %: x 1 ]inch map showing the general geographical location of the facility and any neazby landfills, mine or mill tailings, or any other known or suspected sources of pollutants; g. An 8 %: x 11 inch sketch of the facility showing all structures, outfalls and receiving water, as well as storage locations of any petroleum or chemicals on site; and h. A chemical analysis of the water to be dischazged. If no water is available, this shall be indicated.- L`the discharge is to a storm sewer system, ditch, or other manmade conveyance, approval from the owner of the system must be obtained before discbazge. At least 30 days before the anticipated date of discharge, such information shall be submitted on the application form to: Colorado Depamneat of Public Health and Environment Water Quality Connol Division WQCD-P-B2 4300 Cherry Creek Drive South Denver, CO 80222-1530 The Division shall Lave vp to thirty days after receipt of the above information to request additional data or deny the authorization to discharge. Upon receipt of additional information, tLe Division stall Lave an additional 30 days to issue or deny authorization to discharge. If the applicant does not receive a request for additional information or a notification of denial from the Division within thirty days, authorization to discharge in accordance with the terms and conditions of the permit stall be deemed granted. If the Division determines that a new facility does not fall under the authority of the general permit, then the information received will be processed for an individual permit and discharge will not be allowed until 180 days after the date the application was received. The applicant shall be notified of such a determination. If during the renewal process, the Division determines that a facility no longer qualifies for the general permit, the facility will be allowed to dischazge under the general permit until an individual permit is issued. 3. Authorization to discharge under this general permit shall expire on June 30.2007. The Division must evaluate this general permit once every five yeazs and must recertify all applicants' authority to discharge under the general permit at such time. Therefore, a pemvttee desiring continued coverage under the general permit must reapply by January 1.2007. The Division will determine if the applicant continues to operate under terms of the general permit.
