Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />RECEIVED <br />OCT 17 ZO14 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />I have reviewed your letter dated September 22, 2014 and subsequent emails, inquiring <br />about the ability of the land owner to keep an existing pond that was constructed by Energy <br />Fuels Coal, Inc. The pond, Pond 4, is one of 4 ponds that were constructed for stormwater <br />runoff from the mining area. The owner would like to keep Pond 4 as a permanent structure. <br />If water is held longer than 72 hours, the owner will need to obtain a plan for <br />augmentation through the Division 2 Water Court. The initial fill of the pond and gross <br />evaporation from the surface area of the pond will need to be replaced to prevent injury to water <br />rights. It is advised that the owner should work with a consultant to determine the amount of <br />water in the pond in acre -feet and determine the rate of evaporation on a monthly basis in acre - <br />feet. A substitute water supply plan, pursuant to C.R.S. §37 -92- 308(4), should be submitted to <br />this office concurrently, referencing the court application. I also recommend that the owner work <br />with our personnel in our Division office in Pueblo.
