DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
October 17, 2014
Mr, Robert D. Zuber
Colorado Division of Reclamation, Mining and Safety
1313 Sherman St., Rm. 215
Denver, CO 80203
RE: Southfield Mine (Permit No. C- 1981 -014) Pond 4
NW1 /4 NW1 /4 Sec. 30, T30S, R69W, 6" P.M.
Water Division 2, Water District 12
Dear Mr. Zuber:
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
RECEIVED
OCT 17 ZO14
DIVISION OF RECLAMATION
MINING AND SAFETY
I have reviewed your letter dated September 22, 2014 and subsequent emails, inquiring
about the ability of the land owner to keep an existing pond that was constructed by Energy
Fuels Coal, Inc. The pond, Pond 4, is one of 4 ponds that were constructed for stormwater
runoff from the mining area. The owner would like to keep Pond 4 as a permanent structure.
If water is held longer than 72 hours, the owner will need to obtain a plan for
augmentation through the Division 2 Water Court. The initial fill of the pond and gross
evaporation from the surface area of the pond will need to be replaced to prevent injury to water
rights. It is advised that the owner should work with a consultant to determine the amount of
water in the pond in acre -feet and determine the rate of evaporation on a monthly basis in acre -
feet. A substitute water supply plan, pursuant to C.R.S. §37 -92- 308(4), should be submitted to
this office concurrently, referencing the court application. I also recommend that the owner work
with our personnel in our Division office in Pueblo. They can be contacted at (719) 542 -3368.
Should you have any question, feel free to contact me.
Sincerely,
Heidi Frey, P.E.
Water Resource Engineer
CC: Steve Witte, Division Engineer
Joshua Kasper, Water Commissioner
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
http://water.state.co.us
