Vallejo St. <br /> Englewood, CO 80110 <br /> RE: Alma Placer Mine; Permit No. M-1985-029; Reason to Believe a Violation Exists <br /> and Notice of Board Hearing <br /> Dear Mr. Murray, <br /> On October 3, 2014, the Division of Reclamation, Mining and Safety(Division) conducted an <br /> inspection of the Alma Placer Mine (Permit M-1985-029) and found the following: <br /> Wash water from Pond 4 back-flowed through the fresh water intake pipe into the North Fork of <br /> the South Platte River. <br /> Based on the findings of the inspection we believe this is a violation pursuant to: <br /> • C.R.S. 34-32-116(7)(g) for failure to minimize disturbances to the prevailing hydrologic <br /> balance of the affected lands and the surrounding area and to the quality and quantity of <br /> water in surface and groundwater systems both during and after the mining operation and <br /> during reclamation. <br /> • C.R.S. 34-32-116(7)(h) for failure to protect areas outside of the affected lands from <br /> slides or damages during the mining operation and reclamation. <br /> • C.R.S. 34-32-124 for failure to follow the conditions of an order, permit or regulation. <br /> Therefore, the Division has reason to believe that a violation exists to the Mined Land <br /> Reclamation Act, C.R.S. 34-32-101 et sic., and have scheduled this matter to appear before the <br /> Mined Land Reclamation Board. <br /> A Formal Public Hearing will be held during the November 19-20, 2014 Board Meeting for <br /> consideration of this possible violation. The hearing will be held in Room 318 of 1313 Sherman <br /> Street, Denver, Colorado, beginning at 9:00 a.m. on November 19 or as soon thereafter as the <br /> matter can be considered.
