PERMIT#:M-1977-075 <br /> INSPECTOR'S INITIALS: ERR <br /> INSPECTION DATE: September 15,2014 <br /> OBSERVATIONS <br /> The Division of Reclamation,Mining and Safety(Division)conducted an inspection of the Holyoke Gun Club Pit,Permit <br /> File No.M-1977-075, operated by Holyoke Gun Club. The mine is located just east of Holyoke, Colorado. Elliott Russell <br /> of the Division inspected the site while Aaron Schlachter and Stacy Rueter,both of the Holyoke Gun Club, accompanied <br /> the inspection. <br /> At 13:00,the Division met Mr. Schlachter and Mr. Rueter at the mine site entrance near the club's recreational pond/park. <br /> Access to the area is located on the south side of U.S. Highway 6, 1 '/ miles east of U.S. Highway 385. At the time of the <br /> inspection it was hot,the weather was clear, and the ground was dry.The mine site identification sign was observed on at <br /> the entrance,but was not in compliance with Rule 3.1.12(1). In addition, none of the permit boundary markers could be <br /> located during the inspection. These two problems will be cited in this report,requiring corrective action.There was no <br /> equipment on site at the time of the inspection. <br /> The site appeared to not have been active for at least 1 growing season due to the abundance of volunteer weed species <br /> and the presence of standing water in the working areas. The northern portion of the site had been roughly graded to the <br /> approved reclamation slope of 3H:1 V. Just to the south of this northern slope,was a small stockpile of material.The <br /> active dig-face was located in the southern portion of the pit;this highwall was near vertical and approximately 15 feet <br /> tall. It appeared that topsoil was salvaged and piled along the top of the highwall. <br /> The Division discussed the following with Mr. Schlachter and Mr. Rueter: The Division approved a Conversion <br /> Application of the Holyoke Gun Club Pit on July 5, 2013, increasing the permit from 7 acres to 16.25 acres.Before <br /> finalizing this approval,the Division needed to receive the additional required financial warranty that was associated with <br /> the conversion and additional permitted acreage.The total financial warranty required under M-1977-075 was calculated <br /> by the Division and set at$38,022.89.The Division currently held$2,500.00, so the Operator was required to submit an <br /> additional financial warranty in the amount of 35,522.89 within 365 days before the Division could finalize the <br /> conversion.The deadline to post the additional financial warranty expired on July 5, 2014; the Division has not received <br /> the additional amount. <br /> During the inspection, it became apparent that the site had recently been mined and expanded south into the conversion <br /> area.The Division walked the disturbance boundary with the Trimble Juno 313 GPS unit and prepared the attached map <br /> with the data.The dashed black line represents the original 7 acre 11 Oc permit boundary and he yellow line is the 16.25 <br /> acre I I2c permit boundary; this lines were determined by geo-referencing the attached 2013 Exhibit C Map. The red line <br /> shows the area outside of the original 110c permit boundary which has been disturbed.Total disturbed area(red and <br /> dashed black lines)is approximately 8.45 acres;total disturbed area outside of the approved 110c permit boundary is <br /> 1.45 acres. Land has been affected outside of the approved permit boundary, this will be cited as a possible <br /> violation of C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the affected land from slides or <br /> damages occurring during the mining operation. <br /> Photographs taken during the inspection are attached. <br /> Page 2 of 6 <br />
