<br /> WITNESSETH:
<br /> THAT, Grantor, for and in consideration of Grantee's performance of the Dirt Work on
<br /> Grantor's Property as described ' ttte Agreement of Purchase and Sale of Real Property between
<br /> Grantor and Grantee dated ,L,�, lc-1 2014, and other good and valuable
<br /> consideration, the receipt and sufficient of which are hereby acknowledged, has granted,
<br /> bargained, sold and conveyed, and by these presents does grant, bargain, sell, convey, and
<br /> confirm,unto Grantee all the real property,together with improvements,if any,situate,lying and
<br /> being in the County of Larimer, State of Colorado, more particularly described on Exhibit A,
<br /> attached hereto,consisting of 4 pages,and incorporated herein by this reference,which real property
<br /> shall be hereinafter referred to as the"Property".
<br /> TOGETHER with all and singular the hereditaments and appurtenances thereto
<br /> belonging, or in anywise appertaining, and the reversion and reversions, remainder and
<br /> remainders, rents, issues and profits thereof; and all the estate, right, title, interest, claim and
<br /> demand whatsoever of the Grantor, either in law or equity, of, in and to the Property, and the
<br /> hereditaments and appurtenances;
<br /> EXCLUDING, the oil and gas rights associated with the Property as such rights are
<br /> hereby reserved by Grantor(the"Oil and Gas Rights) subject to the limitation that Grantor will
<br /> not conduct any operations on the surface of Property and the only mechanism pursuant to which
<br /> the exercise of Oil and Gas Rights may affect the Property will be through directional drilling or
<br /> similar method that leaves the Property surface undisturbed.
<br /> TO HAVE AND TO HOLD the Property with the appurtenances, unto the Grantee, its
<br /> successors and assigns forever. Grantor for itself, its successors and assigns, does covenant and
<br /> agree that it shall and will WARRANT AND FOREVER DEFEND the above-bargained
<br /> premises in the quiet and peaceable possession of Grantee, its successors and assigns, against all
<br /> and every person or persons claiming the whole or any part thereof, by, through or under
<br /> Grantor, except with respect to those encumbrances identified on Exhibit B attached hereto and
<br /> incorporated herein by reference.
