There are currently three active stipulations on the permit: <br />Stipulation No. 34 <br />Within 45 days of issuance of TR -77, BRL must submit a technical revision to address <br />the following for proposed Borrow Areas 91, 42, and 93 at Gob Pile 92: <br />a. A topsoil salvage, storage, and redistribution plan, in accordance with Rules <br />2.05.3(5), 2.05.4(2)(d) and 4.06.4(2); <br />b. A regrading plan in accordance with Rules 4.14.1 and 4.14.2; <br />c. A revegetation plan in accordance with Rule 4.15; <br />d. A sediment control plan in accordance with Rules 2.05.3(4), 2.05.6(3), 4.05.1, and <br />4.05.2; <br />e. Revised map(s) in accordance with Rule 2.10.3, clearly indicating the areas <br />proposed for disturbance; <br />f. A reclamation plan and cost estimate in accordance with Rule 2.05.4; and <br />g. A commitment from BRL that materials excavated from any borrow area will be <br />direct hauled for the purpose of covering refuse material, and will not be <br />incorporated into the refuse material, such as for drying purposes. <br />The revision submittal due date was subsequently extended until October 15, 2014 <br />Stipulation No. 35 <br />Commencing with issuance of TR -77, BRL must conduct a survey to determine the <br />volume of coverfill material in the stockpiles associated with Gob Piles 41, 92, 93, and <br />#4 on at least a quarterly basis. A report summarizing the survey shall be submitted <br />within 30 days of the survey, and must include a statement of whether the volume of <br />available material is sufficient to meet the requirements of Rule 4.10.4(5) and the <br />material balance in the currently approved permit application package. <br />To date, BRL has submitted the required quarterly surveys. The stipulated <br />requirement to submit quarterly surveys will continue until the refuse areas are <br />reclaimed or BRL discontinues the practice of using cover material to mix with refuse <br />to achieve the required degree of compaction. <br />With the approval of Permit Revision No. 14, the following additional stipulations will become a <br />binding part of the permit: <br />Stipulation No. 38 <br />PRIOR TO ANY SURFACE DISTURBANCE OF LANDS WITHIN THE SPRUCE STOMP LEASE AREA (COC- <br />75916), THE BASELINE VEGETATION INFORMATION REQUIRED UNDER RULE 2.04.10 MUST BE <br />SUBMITTED TO AND APPROVED BY THE DIVISION. <br />Stipulation No. 39 <br />PRIOR TO ANY SURFACE DISTURBANCE OF LANDS WITHIN THE SPRUCE STOMP LEASE AREA (COC- <br />75916), THE BASELINE SOILS RESOURCE INFORMATION REQUIRED UNDER RULE 2.04.9 MUST BE <br />SUBMITTED TO AND APPROVED BY THE DIVISION. <br />Stipulation No. 40 <br />PRIOR TO ANY SURFACE DISTURBANCE OF LANDS WITHIN THE SPRUCE STOMP LEASE AREA (COC- <br />75916), BRL WILL NEED TO EVALUATE THE EFFECTS OF THAT DISTURBANCE ON ANY OF THE SITES <br />Page 3 of 46 <br />
