XIII. Protection of Fish, Wildlife and Related Environmental Values <br />A discussion of measures to be taken by the BRL to mitigate impacts to wildlife, and in <br />response to comments and suggestions from the Colorado Division of Wildlife, may be <br />found in Section 2.05.6(2) of the permit. <br />A. The applicant has not proposed the use of persistent pesticides on the site during <br />mining and /or reclamation operations. (4.18(5)(g)). <br />B. Fish and wildlife habitat is a planned post- mining land use. The applicant has <br />selected appropriate plant species and distributions to benefit fish and wildlife <br />(4.18(5)(i)). <br />XIV. Protection of Underground Mining <br />The Division does not propose to approve surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine (4.19(1) and 4.22.4(1)). <br />Surface facilities and refuse areas have been constructed within 500' of the abandoned <br />King Mine and the active Bowie No. 2 Mine workings, but no surface mining activities <br />will be conducted within 500 feet of an active or abandoned underground mine. <br />XV. Subsidence Control <br />Section 2.05.6(6) of the permit contains an inventory of structures and renewable <br />resource lands within the permit area, and a discussion of the possible consequences of <br />subsidence on those structures and lands. A subsidence monitoring plan is also included <br />in this section. A report containing subsidence predictions, impacts and possible <br />mitigation measures may be found in Exhibit 15 of the permit. <br />A. The applicant has proposed a subsidence control plan in accordance with Rule <br />2.05.6(6) and has committed to adopt all measures in order to reduce the likelihood of <br />subsidence, prevent material damage, or mitigate the effects. The Division proposes <br />to approve the plan (4.20.1(2) and 4.20.3(1)). <br />The proposed longwall panels in the Spruce Stomp lease area will be located beneath <br />portions of Stevens Gulch Road, the West Fork of Terror Creek, and other surface <br />water features. <br />No limited extraction zone will be established beneath Stevens Gulch Road. The <br />applicant predicts that subsidence cracks could develop in the road surface, and has <br />proposed a monitoring and mitigation plan to detect and repair any cracks that <br />develop. <br />No limited extraction zone will be established under the West Fork of Terror Creek. <br />Longwall panels will be oriented roughly parallel to the creek in order to reduce the <br />severity of transition points and potential flow interrupting knick points in the creek <br />bed. <br />Page 41 of 46 <br />
