The mine <br />permit area is located on lands depicted on the U.S. Geological Survey 7.5 minute Bowie <br />Quadrangle Map, and the Bowie No. 2 mine portals are located northwest of the Old King Mine <br />portals (also known as the Bowie Mine). The surface facilities are located north and south of <br />Old State Highway 133 near the old town site of Bowie. The mine is located between Stevens <br />Gulch and Hubbard Creek. A portion of the surface facilities is within 100 feet of the outside <br />right -of -way of old State Highway 133. The location of these facilities extends from the old <br />town site of Bowie to about 500 feet east of the old Bowie power plant. <br />Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve, with conditions, <br />an application for a permit revision. <br />The application was submitted by Bowie Resources, LLC for the mine. This decision is based <br />on a finding that the operations will comply with all requirements of the Colorado State Program <br />as found in the Colorado Surface Coal Mining Reclamation Act, Section 34 -33 -101 et seq., <br />C.R.S., and the Regulations promulgated pursuant to the Act. If no request for a formal hearing <br />is made within thirty (30) days of the first publication of the issuance of this proposed decision, <br />this decision will become final. Upon submittal of acceptable surety by the applicant, the permit <br />will be issued. The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />No coal mining operations may be conducted on any Federal surface or coal until the Secretary <br />of the Interior has approved the proposed mining plan. <br />Page 2 of 46 <br />
