The proposed disturbed area was also surveyed for threatened and <br />endangered plant species; however, no such species were found. <br />BRL has provided a general map of vegetation communities located within the PR -14 expansion <br />area. Prior to any surface disturbance in the Spruce Stomp area, BRL will be required to provide <br />detailed information as required by Rule 2.04.10. Accordingly, the following stipulation is <br />placed on the Division's approval of PR -14: <br />PRIOR TO ANY SURFACE DISTURBANCE OF LANDS WITHIN THE SPRUCE STOMP LEASE <br />AREA (COC- 75916), THE BASELINE VEGETATION INFORMATION REQUIRED UNDER <br />RULE 2.04. 10 MUST BE SUBMITTED TO AND APPROVED BY THE DIVISION. <br />Fish and Wildlife Information <br />Detailed fish and wildlife information is presented within Section 2.04.11 of the Bowie No. 2 <br />Mine permit application document. This summary is derived from the referenced permit <br />document section. <br />A detailed list of wildlife species known to occur within the Bowie No. 2 Mine permit area is <br />presented in Volume III, Exhibit 9 of the permit application document. The Bowie No. 2 Mine <br />area is located in an area designated as critical range for deer and elk. The surrounding cliffs are <br />possible nesting and /or roosting sites for all species of raptors. The Colorado Division of <br />Wildlife and the United States Fish and Wildlife Service were both involved with the Bowie No. <br />2 Mine permit application review. Correspondence from both agencies regarding the proposed <br />Bowie No. 2 Mine is contained within Volume III, Exhibit 9 of the Bowie No. 2 permit <br />application document. <br />Specific site surveys were conducted to ascertain the presence of and potential impacts on <br />threatened or endangered wildlife species. The field surveys conducted prior to this permit <br />revision did not identify any such species, or predict any such impacts. <br />With the Spruce Stomp EA, the BLM requested an informal Section 7 Consultation with the US <br />Fish and Wildlife Service ( USFWS). The USFWS found that the proposed mining activity in the <br />Spruce Stomp lease area "may affect, is not likely to adversely affect" the Greenback Cutthroat <br />Trout, identified in the EA as present in the lease area, and the Canada Lynx, the presence of <br />which is unlikely in the lease area. <br />BRL has predicted that the creek may subsided as much as 5.1', creating a change in the channel <br />slope by as much as 1.5 %. The change in channel gradient is not predicted to have an adverse <br />affect on water quality or quantity, thus subsidence is not likely to adversely affect the <br />Greenback Cutthroat Trout. <br />To further protect the Greenback Cutthroat Trout habitat, the following stipulations have been <br />placed on the BLM lease and incorporated into the permit application package revised for PR -14: <br />• The Rules require the establishment of a stream buffer zone within 100' of any perennial <br />stream; the EA requires a buffer zone of 200' along the West Fork of Terror Creek. BRL <br />has committed to the 200' buffer zone in the permit application pages revised with PR- <br />14. <br />• BRL will not pump water from the East Fork of Terror Creek if flows drop below 1.0 cfs, <br />Page 20 of 46 <br />
