The Division <br />deemed the application to be complete, for purposes of filing, on October 9, 2014. Notice of the <br />application has been posted in the Division's Denver office. <br />With MR -39, GCC Energy, LLC (GCC) proposes to update King I Maps 005 (Mine Plan) and <br />013 (Subsidence Monuments) to identify features described in GCC's quarterly Subsidence <br />Monitoring Reports for the King Coal Mine. The application also included Modification 1 to <br />Fugitive Emissions Permit 09LP0202F, to which Final Approval was issued by the Air Pollution <br />Control Division on September 3, 2013. This permit will replace the earlier version of the permit <br />found in Appendix 2(2) of both the King I and King II permit binders. <br />The Division has no comments regarding these three items (two maps and APCD permit). We <br />do, however, have one adequacy question for your consideration and response. <br />In the King II permit volume, Appendix 2(2) includes an additional Emissions Permit — <br />No. I ILP3252. Initial Approval was issued by APCD on November 30, 2011. Has GCC <br />received additional (Final ?) Approval for Permit 11LP3252? If so, please submit the new <br />version for inclusion with MR -39. <br />This concludes the Division's adequacy review of MR -39.
