Enforcement Hearing for Forfeiture of Financial Warranty
To Whom It May Concern,
Mr. George Otten has provided the Mined Land Reclamation Board (Board) with a Certificate of
Deposit for the Financial Warranty for the Mackey Mine, DRMS File No. M-1984-013. At the
September 24, 2014 Board Hearing it was found that the Financial Warranty is subject to
forfeiture. Pursuant to Rule 4.20(2) of the Mineral Rules and Regulations of the Colorado Mined
Land Reclamation Board for Hard Rock, Metal and Designated Mining Operations, the Board is
required to notify all Financial Warrantors that a Financial Warranty is subject to forfeiture. The
pertinent information for the Certificate of Deposit is:

An Enforcement Hearing will be held for this matter. It will occur during the December 18th and
19th, 2014 Board Meeting. The hearing will be held in Room 318 of 1313 Sherman Street,
Denver, Colorado, beginning at 9:00 am on December 18th or as soon thereafter as the matter can
be considered. Pursuant to Rule 4.20(2), when the Board determines a Financial Warranty is
subject to forfeiture, the Board shall afford the Operator and all Financial Warrantors the right to
appear before the Board.
The Board's agenda may not be finalized until the week of the Board meeting. Therefore, we
