Issue resolved; BRL referred the Division to monitoring data for Spring 6 -1 in the 2010 <br />through 2013 annual hydrology reports. <br />c. BRL updated Exhibit 3 of Volume III to include baseline data for the ephemeral gulches <br />in the Spruce Stomp expansion, and revised page 2.05 -126 to include a discussion of the <br />ephemeral gulch monitoring locations. Please also revise page 2.05 -128 to add the <br />nine ephemeral gulch monitoring points to the list of surface water monitoring points. <br />Rule 2.05.3 — Operation Plan <br />25. BRL requested that the Division propose language for a stipulation to be placed on a <br />proposed decision to approve, with conditions, PR -14. DRMS is currently working on draft <br />language for a stipulation and will forward the draft language under separate cover. <br />Additional Item: <br />BRL objected to the language in the Division's proposed Stipulation No. 41, and asked that the <br />Division revise the stipulation to clarify that an augmentation plan would be required before any <br />subsidence causing activities would commence, as opposed to prior to any mining activities <br />affecting the West Fork of Terror Creek. The Division has revised the stipulation language as <br />follows: <br />Stipulation No. 41 <br />PRIOR TO COMMENCING ANY MINING ACTIVITIES THAT COULD CAUSE SUBSIDENCE IN THE SPRUCE <br />STOMP LEASE AREA, BRL MUST SUBMIT A COPY OF A COURT APPROVED AUGMENTATION PLAN <br />DEMONSTRATING THAT, SHOULD MINING ACTIVITIES RESULT IN CONTAMINATION, DIMINUTION OR <br />INTERRUPTION OF WATER IN THE WEST FORK OF TERROR CREEK, BRL HAS OBTAINED SUFFICIENT <br />WATER RIGHTS AND AN APPROVED WATER REPLACEMENT PLAN TO RESTORE, REHABILITATE, OR <br />REPLACE THE WATER SUPPLY. <br />If you have any questions or need additional information, please contact me. <br />Sincerely, <br />Susan L.
