William A. Bear
October 6, 2014
13. b. Issue resolved; BRL referred the Division to monitoring data for Spring 6 -1 in the 2010
through 2013 annual hydrology reports.
c. BRL updated Exhibit 3 of Volume III to include baseline data for the ephemeral gulches
in the Spruce Stomp expansion, and revised page 2.05 -126 to include a discussion of the
ephemeral gulch monitoring locations. Please also revise page 2.05 -128 to add the
nine ephemeral gulch monitoring points to the list of surface water monitoring points.
Rule 2.05.3 — Operation Plan
25. BRL requested that the Division propose language for a stipulation to be placed on a
proposed decision to approve, with conditions, PR -14. DRMS is currently working on draft
language for a stipulation and will forward the draft language under separate cover.
Additional Item:
BRL objected to the language in the Division's proposed Stipulation No. 41, and asked that the
Division revise the stipulation to clarify that an augmentation plan would be required before any
subsidence causing activities would commence, as opposed to prior to any mining activities
affecting the West Fork of Terror Creek. The Division has revised the stipulation language as
follows:
Stipulation No. 41
PRIOR TO COMMENCING ANY MINING ACTIVITIES THAT COULD CAUSE SUBSIDENCE IN THE SPRUCE
STOMP LEASE AREA, BRL MUST SUBMIT A COPY OF A COURT APPROVED AUGMENTATION PLAN
DEMONSTRATING THAT, SHOULD MINING ACTIVITIES RESULT IN CONTAMINATION, DIMINUTION OR
INTERRUPTION OF WATER IN THE WEST FORK OF TERROR CREEK, BRL HAS OBTAINED SUFFICIENT
WATER RIGHTS AND AN APPROVED WATER REPLACEMENT PLAN TO RESTORE, REHABILITATE, OR
REPLACE THE WATER SUPPLY.
If you have any questions or need additional information, please contact me.
Sincerely,
Susan L.
