Box 483 <br />Paonia, CO 81428 <br />Re:Bowie No. 2 Mine (Permit No. C-1996-083) <br />Technical Revision No. 93 (TR-93) Gob Pile#3 –East Drying Area <br />Preliminary Adequacy Review <br />Dear Mr. Bear: <br />An application for TR-93 was received by the Division on September 16, 2014. The application <br />was submitted by J.E. Stover & Associates, Inc. on behalf of Bowie Resources, LLC (BRL). <br />With this revision, BRL proposes to designate a 2.1-acre refuse drying area at Gob Pile #3. <br />The Division deemed the application to be complete, for purposes of filing, on September 18, <br />2014.Various Federal, State and Local agenciesreceived notification letters fromthe Division, <br />within which comments were requested by October 3, 2014. Colorado Parks and Wildlife (Area <br />16)responded by Email on September 23, 2014, stating that their office had no comments on the <br />proposal. The State Historic Preservation Officer commented on October 3, 2014 that a “finding <br />of no historic properties affected” is appropriate. No other agency comments were received. <br />Proof of Publication for BRL’s public notice was provided to the Division on September 19, <br />2014. The notice appeared inthe September 17, 2014 edition of the Delta County Independent. <br />No comments were received from the public within the prescribed comment period, which came <br />to a close on Monday, September 29, 2014. <br />An updated Reclamation Cost Estimate specific to TR-93 was transmitted to BRL by Susan <br />Burgmaier of the Division on October 6, 2014. The total increase is $108,196.21 which, when <br />combined with the surety currently required for the Bowie No. 2 Mine ($11,325,862.66), exceeds <br />the amount of surety currently posted($11,339,730.57). <br />The Division has reviewed the TR-93 application for adequacy. Our comments are provided <br />below for your consideration and response. <br />1.Revised page 4b of Volume XI depicts an “East Gob Drying Area” occupying the area <br />currently permitted for Coverfill Stockpile-1 (CS-1).
