MANAGEMENT <br />The Division's letter dated September 29th transmitted its fourth adequacy review for Permit <br />Revision No. 14 (PR -14) for the Bowie No. 2 Mine. On behalf of Bowie Resources, LLC (BRL) <br />following are its responses to the DRMS' comments and questions. <br />Rule 2.03.6 — Right of Entry and Operation Information <br />5. BRL has not yet responded to this issue: Pages 2.03 -8 and 2.03 -15 reference Federal <br />Coal Lease COC75916 providing right of entry to mine the coal in the proposed PR -14 expansion <br />area. The Division requested a status update on the lease approval process, and BRL has since <br />notified the Division that BRL was awarded lease sale on July 30, 2014. Please provide right of <br />entry information for Lease COC75916 when it is obtained. <br />BRL - The lease is attached. The lease has two significant errors in the stipulation <br />language. One is regarding the buffer zone for wild and scenic rivers. The second is the <br />language that states an augmentation plan for replacement water must be decreed prior to <br />mining in the lease. Both of these stipulations are in conflict with BLM's record of decision.
