PERMIT#: M-2010-055
INSPECTOR'S INITIALS:PSH
INSPECTION DATE: September 26,2014
The 112c construction permit for the Konig Borrow Pit was issued by the Division on December 28, 2010. The
site is permitted for 35.0 acres of total disturbance with a maximum allowed disturbance of 17.5 acres at one
time. The site is divided in half with Phase 1 in the eastern portion and Phase 2 in the western portion of the
site. The Division holds a reclamation bond in the amount of$42,000.00, which appeared adequate to
complete reclamation at the site based on this inspection.
The site was inactive during the inspection. Mr. Konig stated stockpiled material was removed from the site
two days before the inspection. Evidence of recent stockpile activity was observed during the inspection. The
most recent mining excavation occurred in the northwest corner of Phase 2. The western edge of the
disturbance was mined at the required 3H:1V slope. The mining excavation depth was estimated at less than
10 feet, which is consistent with the approved mining plan. No processing equipment was observed at the site
and Mr. Konig stated the site is strictly a borrow pit.
Based on a difference in vegetative cover, it appears all of mining Phase 1 has been stripped of topsoil ahead
of mining excavation. Topsoil stockpiles were observed along the southern boundary of Phase 1 and in the
northeast corner of Phase 1. All topsoil stockpiles were adequately vegetated and no erosion features were
noted. The approved post mining land use for the site is pastureland. The site is currently being used as a
horse pasture. No reclamation activities were observed during the inspection.
As stated as problems on the first page, the required mine sign and boundary markers were not observed
during the inspection. The Operator must post a sign at the entrance of the site and replace the boundary
markers by the corrective action due date. Mr. Konig stated the boundary markers have been replaced
several times; however the livestock kept on the property knock down the markers.
The site was GPS surveyed by the Division using a Trimble Juno 3B unit. The survey results indicated an
affected area of 16.40 acres, which is under the approved maximum allowance of 17.5 acres. A map of the
survey results and other inspection items is enclosed.
Photographs taken during the inspection are attached.
Inspection Contact Address
Mr. Joel Konig
Konig Ag Co.
37231 Hwy. 14
Briggsdale, CO 80611
Enclosure: Inspection Map
Cc: Tom Kaldenbach, DRMS
