Where there is not State ownership of the surface, CDOT is shown as the surface owner <br />(note that portions of the Highway exist under right -of -ways from the surface owners, as <br />shown). Map I has been modified to reflect those areas owned /managed by CDOT. Lands <br />previously held by Lorence and Raeola Ellgen have been transferred to the family trust. <br />now shown as Larry and Gary Ellgen, and Lorence has been removed from the ownership <br />listing. The Moffat Limestone and Elof Wheeler holdings are not contiguous with the <br />Permit Boundary, and have been removed from both the maps and ownership listing. The <br />Raftopoulis holdings are now shown under Diamond Peak Land Company, LLC so <br />Raftopoulis has been removed from the ownership 111g. K & P Musgrave hasAkn <br />added to the ownership listing. <br />The following names are depicted on the Coal Ownership Map #2 but are not listed <br />as coal owners on revised pages 2.03 -8 to 11: Bennett and Rossomondo, Edna <br />Paulson & Florence Vantassel, BHP -Utah Petroleum and Trapper Mining. The <br />following entities are listed as coal owners on revised pages 2.03 -9 to l l but are <br />not depicted on the Coal Ownership Map #2: Danna and Dale Cook, Entrust <br />Freedom, Bruce Haustein and Karen Godley, Jeffery Herrick, Adriana Herrick - <br />Juarez, Pierre & Kaye Johnson Family Trust, Alice Koonce, Anne Livingston, <br />Mitchell Management Trust, Ross Oil Company, Mathew Sandefur, Amaryllis <br />May Simpson, W.F. The <br />1 Ownership Map and ownership listing have been modified, as appropriate. <br />Rule 2.03.8 — Permit Term Information <br />1) Rule 2.03.8(2) requires the applicant to cite the anticipated number of acres of surface lands to be <br />affected during the permit term. Please revise section 2.03.8 of revised page 2.03 -19 to indicate if <br />any additional surface acres will be disturbed during this permit term. Also, please indicate the <br />number of surface acres currently disturbed at the site. <br />2) Revised Map 24 scale is too small to read the dates and other information provided on the map <br />image. Also, the vertical extent of the proposed underground mine working are not visible or not <br />depicted on the map. Please increase the scale of Map 24 so the required information is visible <br />and indicate the vertical extent of the underground mine workings. <br />a. MCM Response to items 1 and 2: Page 2.03 -19 has been revised to include disturbed <br />and affected acreage information, and the revised page is included with these responses. <br />Map 24 has been revised to delete the information on mining dates for areas already mined <br />and add coal seam elevation data. <br />
