COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />October 1, 2014 <br />Tony Tennyson <br />Tri -State Generation EtTransmission <br />Association, Inc. <br />5731 State Highway 13 <br />Meeker, CO 81641 <br />RE: NOI(s) X- 2004 - 109 -10, X- 2005 - 109 -11, and X- 2005 - 109 -12 <br />Bond Release Request(s) (SL -2) Adequacy Comments <br />Dear Mr. Tennyson, <br />The Division received a request for release for the following Notice of Intents to Explore: <br />X- 2004 - 109 -10 <br />X- 2005 - 109 -11 <br />X- 2005 - 109 -12 <br />The Division conducted a bond release inspection of the sites associated with the above <br />referenced NOIs on September 24th, 2014. Based on the bond release inspection and a review <br />of the above referenced NOIs, the Division has the following comments: <br />X- 2004 - 109 -10 - The Division currently holds a Corporate Surity in the amount of $161,241.00 <br />of which $42,665.00 is required for remaining reclamation of the activities associated with the <br />NOI. Based on the September 24, 2014 inspection, Site C -04 -02 is eligiable for release. A total <br />of 16 ground water monitoring wells (Site C- 04 -16, 13 wells, Site C- 04 -36, 2 wells, and Site C- <br />04-38, 1 well) are currently installed and not yet reclaimed. The Division understands that it is <br />the intention of Colowyo Coal to transfer or abandon these wells. Please note the <br />requirements for release of the remaining wells: <br />• Transfer of wells to the Colowyo Mine (C- 1981 -019) - A Minor Revision to the C -1981- <br />019 permit with associated bond to add the wells to the permit <br />• Transfer of wells to the landowner - A DWR well permit in the name of the landowner <br />and a request by the landowner to assume responsibility for the well. <br />• Abandonment of the well - An abandonment report submitted as required under Rule <br />4.07.3(3) ensuring proper and permenant sealing of the well per Rule 4.07.3(2). <br />X- 2005 - 109 -11 - The Division currently holds a Corporate Surity in the amount of $470,711.00 <br />of which $4,618.00 is required for remaining reclamation of the activities associated with the <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
