Box 1660 <br /> Cortez, CO 81321 <br /> September 30,2014 <br /> RE: Craig Pit,Permit M-1976-027,Request for Temporary Cessation,Incomplete Submittal, <br /> Notice of Pending Violation <br /> Dear Mr.Peabody, <br /> On September 17,2014 the Division of Reclamation,Mining and Saffety(Division)received Skanska's <br /> request to place the Craig Pit into Temporary Cessatio(TC). At this time the Division must call the <br /> Notice incomplete. <br /> Per Rule 1.13.5(2)(e)the operator must demonstrate that the existing financial warranty is adequate to <br /> cover the reclamation liability. On March 28, 2014 the Division noticed Skanska of a financial warranty <br /> increase from$104,810 to$158,629.74. The Division then sent a reminder on July 8, 2014 regarding the <br /> increase. To date the Division has not received the increase of$53,819.00. Therefore the financial <br /> warranty is not adequate to cover the reclamation liability. <br /> Further,Per Rule 4.2.1 (2)an operator has 60 days from the date of notice to post additional financial <br /> warranty from the date of said notice. Clearly Skanska has been given twice that amount of time with a <br /> reminder and has failed to submit the appropriate increase for this site and the Red Mesa Pit,permit M- <br /> 2009-023. Therefore,the Division will be sending Skanska a Reason to believe a violation exists for the <br /> two permits and scheduling an enforcement hearing before the Mined Land Reclamation Board for the <br /> November 19,2014 meeting. Please submit the increases immediately.
