As set forth <br /> in Rule 8.4.1(c),this emergency response�uthority includes the authority to issue a Cease and <br /> Desist Order for an activity suspected of ausing an emergency situation. The Division has <br /> determined that mining activities at the move-referenced site have created pitwall slopes that are <br /> steeper than the maximum 45 degrees allowed in the approved permit,and is a possible violation <br /> of a permit condition pursuant to Section 34-32.5-124 of the Act. The pitwall slopes result in a <br /> suspected immediate and undue risk of serious harm to persons,property,or the environment, <br /> and,therefore,have created an emergency. To allow the Division time to further inspect the site, <br /> evaluate the risk,and evaluate a reclamation plan,the Division orders Sanborn Sand and <br /> Gravel/dba Golden Cross Aggregate an4 its associates to immediately cease and desist all <br /> mining operations in the pit on the abovo-referenced site,with the exception of reconstructing <br /> pitwalls to comply with the maximum allowed slope. Until this Cease and Desist Order is lifted <br /> by the Division,no one is permitted to c duct mining operations in the pit other than for the <br /> purpose of reconstructing pitwalls to co�ply with the maximum allowed slope. <br /> Virginia Brannon Date <br /> Division Director <br />
