Box 483 Paonia, CO 81428 Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) Permit Revision No. 14 (PR- 14) Spruce Stomp Expansion — Federal Coal Lease No. COC75916 Third Adequacy Review Dear Mr. Bear: The Division has reviewed the September 2, 2014 response submitted by JE Stover and Associates on behalf of Bowie Resources, LLC (BRL) to the Division's second adequacy review letter for Permit Revision No. 14 (PR -14) for the Bowie No. 2 Mine. The revision proposes to incorporate the Spruce Stomp Lease and associated mine plan into the currently approved permit application package. We have the following comments and questions regarding BRL's response: Rule 2.03.4 — Identification of Interests 1. BRL provided updated ownership and control information for Bowie Resources, LLC. The Division is currently reviewing the revised information and will provide any comments under separate cover. Rule 2.03.6 — Right of Entry and Operation Information 5. BRL has not yet responded to this issue: Pages 2.03 -8 and 2.03 -15 reference Federal Coal Lease COC75916 providing right of entry to mine the coal in the proposed PR -14 expansion area. The Division requested a status update on the lease approval process, and BRL has since notified the Division that BRL was awarded lease sale on July 30, 2014. Please provide right of entry information for Lease COC75916 when it is obtained.
