PERMIT#: M-1984-094 <br /> INSPECTOR'S INITIALS:MAC <br /> INSPECTION DATE: September 8,2014 <br /> INSPECTION TOPIC: Topsoil <br /> PROBLEM/POSSIBLE VIOLATION: Possible Violation: During the inspection, it was discovered that there is <br /> inadequate topsoil to complete the approved reclamation at the site. This is a problem related to C.R.S. 34-32.5- <br /> 116(4)(g) for failure to remove and segregate topsoil from other spoil. <br /> CORRECTIVE ACTIONS: This possible violation will require a hearing before the Mined Land Reclamation Board. <br /> The schedule and other details for the MLRB hearing will be provided under a separate document to be sent via <br /> certified mail to the Operator. <br /> CORRECTIVE ACTION DUE DATE: 10/29/14 <br /> OBSERVATIONS <br /> The inspection was conducted by Michael Cunningham, Tony Waldron and TC Wait of the Division of <br /> Reclamation, Mining and Safety (Division). Michael Pfister was present on behalf of Golden Cross Aggregate. <br /> The Gloria Z Mine is located approximately one mile northwest of Fairplay, CO on the south side of the middle <br /> fork of the South Platte River. The site is permitted for 45.04 acres and the post-mining land use is rangeland <br /> and developed water resource. <br /> The purpose of this inspection was to follow up on corrective actions the Division issued following the <br /> inspection conducted on July 10, 2014. Following the last inspection the Operator was instructed to complete <br /> the following corrective actions: <br /> 1) Ensure all fuel is properly stored with the necessary secondary containment. <br /> 2) Reduce the highwalls within the excavation area to 45 degrees or flatter. <br /> 3) Replace Ditch No. 2 along the northern perimeter of the site. <br /> The Division verified the used oil being stored in five gallon buckets had been transferred to a proper storage <br /> tank. The five gallon buckets were still present on site and should be properly disposed. Per Rule 3.1.5(5), all <br /> refuse shall be disposed of in a manner that will control unsightliness and protect the drainage system from <br /> pollution. <br /> The Division inspected the areas where active mining is occurring including those areas which had been mined <br /> earlier in the season. The Mining Plan, which was most recently updated through Amendment No. 2 in 2013, <br /> states that pit walls will be maintained at 45 degrees from horizontal. During the review of Amendment No. 2, <br /> the Division determined that based on a proposed pit depth of 90 feet,the internal highwalls needed to be <br /> maintained at 45 degrees or flatter for the safety of the workers in the pit. Therefore, the Operator is <br /> responsible for ensuring the internal walls of any new pits are mined at 45 degrees or flatter. The Operator is <br /> currently mining near the northern permit boundary. Since the previous inspection, the Operator had <br /> backfilled sections of the highwall along the northern permit boundary to the required 45 degrees. However, <br /> the internal highwalls within the area where excavation was occurring were near vertical and had not been <br /> reduced as specified by the Mining Plan. <br /> The Division inspected the ditches along the northern perimeter of the site. During the last inspection,the <br /> Division found that Ditch No. 2 was partially blocked with fill material. The Operator was instructed to <br /> Page 2 of 5 <br />
