(Tri- State) has received your adequacy <br />letter for TR -06, dated July 17, 2014 and provides the following responses to your comments on behalf of <br />the Western Fuels - Colorado, A Limited Liability Company (Western Fuels- Colorado) New Horizon <br />North Mine. <br />1. This submittal indicates that the schedule for mining at New Horizon North will be delayed by <br />approximately two years. Please explain ifthis will or will not be an issue in the context of the <br />need for contemporaneous reclamation (Rule 4.13). <br />Response: In this technical revision application, the proposed mining boundary has been revised <br />to take into account the recently approved wetland delineation so that no mining is proposed <br />within wetland areas. Also, the mining schedule has been revised to reflect the most current New <br />Horizon North budget timing. Therefore, the Reclamation Time Table in Table 2.05.4(2)(a) -1 has <br />also been updated to reflect this change in mining schedule in order to comply with Rule 4.13 as <br />it applies to contemporaneous reclamation. <br />2. This submittal indicates that the post- mining topography will change. Please address this change <br />in other applicable parts of the Permit Application Package, including (but not necessarily <br />limited to) Map 2.05.4 -1 and Map 2.05.4 -2. Please explain if the change in topography impacts <br />the analysis of other ponds (e.g., Pond NHN 001). <br />Response: The previous submittal contained a post -mine topography that may be submitted to <br />the Division in the future. Therefore, Map 2.05.3(4) -1 and Map 2.05.3(4) -9 have been updated <br />with the currently approved post -mine topography. <br />3. In Section 2 05.3(4) it is unclear what has been changed. The cover letter says pages I — 6, but <br />only four of these pages were submitted. Please confirm that page I and page 5 had no changes. <br />In the Table of Contents, "Design Methodology " was deleted: is this an error? The format of <br />headings appears to be inconsistent: please correct this. <br />Response: The headings, subheadings, and Table of Contents have been revised to make this <br />entire section clearer. Therefore Section 2.05.3(4) is being submitted in its entirety as part of this <br />adequacy response.
