decision not to show individual claim boundaries on the map,as the claim boundaries overlap so much
that the maps become difficult to read. A leader was inserted to help clarify patent boundaries.
Comment 6b Shaft Location
Response: The shaft is correctly labeled. People tend to like to add names to features, but the shaft is
correctly labeled as a shaft and it is the same feature that was located on the last version of the permit.
No change has been made to the labeling other than an increase in text size.
Comment 6c Tunnel portal vs.Adit
Typically in mining, it is common to interchange the words"tunnel" and "adit",even though we all know
that the proper term for what is located on this site is an adit. Since, during our discussions, with DRMS,
we have talked about a "tunnel", I have continued to use that term, but chose to use that proper term
on the exhibits. I will added the word "tunnel"to help those unfamiliar with mining terms to also
understand, both terms added at a larger text size.
Comment 6d Justification for 4.4 acre limit on seeding and finishing
Response: This comment does not make much sense. Just because an area is contained within a permit
boundary, does not mean that DRMS regulations require that the operator tear it up. In this case, the
area permitted is 9.3 acres(or 9.35,whichever you want to use), and the total disturbed area within the
permit areas is 4.4 acres. Of these total 4.4 acres, only 3.3 acres is set for reclamation,as the 1.1
remaining acres consist of the landowner's access roads and leveled areas. In order to be conservative
for bonding purposes, I left the area to be 4.4 acres, so that sufficient money would be available for
removing MSHA mandated berms and doing minor changes to the roads. All of the numbers supporting
my calculations are shown in the text and maps, and the specific areas to be reclaimed are clearly shown
in hatching on the reclamation map.
Comment 7—Paragraph 1(k-I) "DRMS knows that gold-bearing ore outside of the diatreme
can have significant sulfides"
Response: DRMS has much knowledge about the ores outside the diatreme, but they appear to be
deficient on their knowledge of where the diatreme is located. The project area is sited within the lithic
tuft unit that occupies the diatreme, commonly referred to as the Cripple Creek Breccia. The statement
made in the exhibit is correct and we have seen no evidence of"significant sulfides". Since the sulfide
3
