b) Sufficiently stable water level and compatible pond configuration for intended use; <br />Pond 4 receives snowmelt and rain shower run -off from the refuse pile area and retains water <br />through most of the year. The pond is configured with wide and gentle sloped shores for the <br />wildlife's and potential livestock's easy access to the water. <br />c) Adequate safety and access for intended water users (i.e., wildlife and livestock); <br />Pond 4 is configured with wide and gentle sloped shores for the wildlife's and potential <br />livestock's easy access to the water and the shores and embankment are well vegetated for <br />stability. <br />d) Prevent diminution of water quality /quantity for affected water rights holders; <br />Pond 4, designed as an approved sedimentation pond, functions to settle out sediment from water <br />run -off entering the pond thereby benefiting the quality of the water. Being a self dewatering <br />pond, when the approved water level /volume is reached in the pond, the pond discharges through <br />the vertical standpipe (primary discharge) enabling the water to flow on downstream. <br />e) Adequate sized impoundment for intended use; <br />As stated previously, throughout the years of EFCI's mining and reclamation activities, numerous <br />Elk in herds numbering from 12 head to 60 head have utilized Pond 4 as a source of water.
