o Implement mitigation measures required by the USFS and BLM to preserve or avoid <br />destruction of cultural resource values. Mitigation may include relocation of proposed <br />facilities, testing, salvage, and recordation or other protective measures. All costs of <br />the inventory and mitigation will be borne by the lessee or operator, and all data and <br />materials salvaged will remain under the jurisdiction of the U.S. Government as <br />appropriate. <br />The lessee or operator will immediately bring to the attention of the USFS and BLM any <br />cultural or paleontological resources or any other objects of scientific interest discovered <br />as a result of surface operations under this lease, and will leave such discoveries intact <br />until directed to proceed by USFS and BLM. <br />INVASIVE, NON- NATIVE SPECIES <br />Noxious weed control will be required along access routes and at drill sites, in accordance with <br />the Colorado Noxious Weed Act. In addition, the following stipulation will be required: <br />■ An inventory will be completed for noxious weeds within the LBA tract before <br />construction begins in order to determine whether there is a need for pre- treatments (with <br />results of the inventory shared with the USFS and BLM weed specialist). <br />THREATENED, ENDANGERED, AND SENSITIVE SPECIES <br />• State -of -the -art mining techniques (pillar and panel widths, rate of coal development and <br />extraction, mine method, determining angle of draw, etc.) will be used to control <br />subsidence. <br />• No mining - related surface disturbance (i.e., MDWs and roads — not including subsidence) <br />will occur within 200 feet of greenback cutthroat trout (GBCT) occupied habitat, as <br />measured from the normal high water mark, without a written finding from the <br />Authorized Officer. <br />• If there are existing roads or disturbance features within the 200 -foot buffer along GBCT <br />habitat streams, then no additional surface disturbance will be permitted within those <br />areas_ Maintenance of roads or other existing features must remain within the existing <br />road prism or footprint of the feature being maintained. <br />• No surface disturbance, such as road widening or upgrading will occur within 200 feet of <br />GBCT occupied habitat, as measured from the normal high water mark, to protect <br />delineated wetlands or riparian areas and maintain riparian vegetation and eliminate <br />potential effects to the GBCT, unless exceptions were approved by the Authorized <br />Officer. <br />• The operator will not store equipment, machinery, or construction materials in any <br />locations that are 200 feet or less from the riparian zones of the streams within the Terror <br />Creek watershed. <br />• During construction or maintenance activities in proximity to the 200 -foot riparian buffer <br />zone, the edge of the buffer zone will be marked for avoidance by construction <br />equipment and activities. <br />E <br />
