Pursuant to Rule 2.03.11(4), please review the Delta and Gunnison County threatened <br />and endangered wildlife species lists and update this section if necessary. If there are <br />any new listed species, a new on the ground survey will be required. <br />MCC contracted with a biologist with Barr Engineering to conduct an updated evaluation of <br />T &E plant and wildlife species that could occur on or near the West Elk Mine site. A copy of <br />the report is attached. The evaluation determined that there are no federally - listed T &E <br />wildlife species that could be impacted by the current mine operations. <br />Rule 2.05.3 — Operations Plan — Permit Area <br />5. Map 51— E -Seam Projected Operations shows the E -Seam workings at the West Elk <br />Mine. The map shows mined areas and projected potential mining areas. Please update <br />Map 51 to show the changes to the mined areas. Please update Map 51 to show the <br />changes in projected potential mining areas to reflect changes to the longwall panel <br />lengths. <br />MCC submitted MR -404 on May 09, 2014 that included updates to Map 51. This map and <br />revision were approved by the Division on June 10, 2014. <br />Rule 3.02.2 — Determination of Bond Amount <br />6. Pursuant to Rule 3.02.2(4) the Division is required to recalculate the reclamation cost <br />estimate at a minimum every 2 -% years with the midterm review. The Division will send <br />the recalculated reclamation cost estimate under separate cover. <br />MCC will review the recalculated reclamation cost estimate after it is received. <br />Rule 4.02.5 — Stream Buffer Zone Markers <br />7. Please review all of the stream buffer zone markers and verify that they are in place as <br />required and that they meet the requirements of Rule 4.05.18. <br />MCC has reviewed the stream buffer zone markers (signs) along the North Fork of the <br />Gunnison River and along Sylvester Gulch and verified that they continue to be in place. <br />Rule 4.05.18 — Stream Buffer Zones <br />8. The West Elk Mine permit discusses stream buffer zones on the North Fork of the <br />Gunnison River and Sylvester Gulch. Since the stream buffer zone Rule applies to all <br />perennial, intermittent and ephemeral streams with a drainage area greater than one <br />mile, please review and discuss al/ of the streams within the West Elk Mine's permit area. <br />If any additional streams are found to be covered by the stream buffer zone Rule, please <br />provide the Division with a plan to properly mark and protect them. <br />MCC again reviewed topographic maps of the main mine site and upper Sylvester Gulch <br />
