Musick pivision of Reclamation, <br />Environmental Protection Specialist min.ing & Safety <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />Re: Seneca II Mine (Permit No. C- 1980 -005), Technical Revision No. 53 JR -53), Termination of Water Quality <br />Monitoring (CHS #66493) <br />Dear Mr. Musick: <br />Thank you for your correspondence dated August 21, 2014 (received by our office on August 26, 2014) <br />regarding the subject undertaking. <br />We understand that the above - referenced technical revision does not change the permitted, affected, or <br />approved disturbed acreage within the Seneca II Mine and, in fact, the undertaking appears largely administrative <br />in nature. As such, it is our opinion that a finding of no historic properties affected is appropriate for this <br />undertaking pursuant to 36 CFR 8004(d)(1). <br />The Section 106 consultation process does involve other consulting parties including, but not limited to the <br />United States Forest Service, local governments and Tribes, which as stipulated in 36 CFR 800.3 are required to <br />be notified of the undertaking. Additional information provided by these consulting parties may cause our <br />office to re- evaluate our comments and recommendations. Please note that our compliance letter does not end <br />the 30 -day review period provided to other consulting parties. <br />If previously unidentified archaeological resources are discovered in the course of the project, work must be <br />interrupted until the resources are properly evaluated in terms of the National Register of Historic Places <br />eligibility criteria (36 CFR 60.4) in consultation with our office. <br />Thank you for the opportunity to comment.
