(Oldcastle) is the owner of land located in Sections 10, 11, and 15, Township 49 North, Range 1 West of the New Mexico Principal Meridian in Gunnison County, Colorado. Oldcastle operates a gravel mining operation on the property referred to as the Gunnison West Gravel Operation. Oldcastle owns several water rights that have historically irrigated the land underlying the property, including 4.33 cubic feet per second (cfs) of the 14 efs decreed to the Seventy Five Ditch Priority No. 1 water right. The water right, decreed in Case No. CA1325, has a duty of water of 1 cfs per 40 acres. Therefore, Oldeastle's share of the water right can irrigate approximately 173 acres of land. At full - buildout, Oldcastle will dry -up approximately 125 acres of land historically irrigated with 3.125 cfs of its share in the Seventy Five Ditch in order to offset out -of- priority depletions resulting from evaporation, production, and dust control. Oldcastle hereby dedicates 3.125 cfs of its 4.33 cfs Seventy Five Ditch Priority No. 1 water right to the Gunnison West Gravel Operation property. Prior to full - buildout, Oldcastle will diy- up such acreage as is necessary to offset out -of- priority depletions occurring at the time. Sincerely, Peter J.
