From: Comaniciu - DNR, loana [ mailto :ioana.comaniciu(@state.co.us]
Sent: Wednesday, October 16, 2013 4:07 PM
To: Raul Passerini
Cc: Lacey Books; Joanna Hopkins; Scott Fifer
Subject: Re: Maryland Creek Ranch Substitute Water Supply Plan DRMS Permit No.M -96 -049
Good Afternoon Raul,
Thank you for the additional information provided and the revised SWSP
report for the Maryland Creek Ranch Pit. Based on my review of the revised
report and your answers to my questions provided I have the following
additional questions /comments:
1. DRMS approach no. 4 - You indicated that in a letter dated March 6, 2010
Everist Materials chose approach no. 4 from the DRMS letter. Note that the 4t"
approach requires documentation to identify what water rights or other
permanent water source will be dedicated to the SWSP to assure that all
permanent depletions from either an unforeseen abandonment of the site by the
Applicant or as a result of long term ground water exposure after completion of
mining and reclamation will be replaced so as to prevent injury to other water
rights. Therefore, in accordance with approach no. 4, Eversit will need to
provide an affidavit that indicates which water rights are dedicated as
replacement water solely for this SWSP for as long as there are depletions at
this gravel pit site or until such time as another replacement source is obtained.
A copy of the affidavit will need to be provided to this office.
loana Comaniciu, P.E.
Water Resource Engineer
State of Colorado, Division of Water Resources
1313 Sherman Street, Room 818
Phone: 303.866.3581 / Fax: 303.866.3589
Email: ioana.comaniciuPstate.co.us
On Mon, Oct 14, 2013 at 10:35 AM, Raul Passerini <Raul(&resource -eng com> wrote:
loana,
Thank you so much for your thorough review of Maryland Creek Ranch's SWSP.
