Mr. Conway <br />Page 2 <br />September 4, 2014 <br />5. The Applicant has stated the disturbance associated with the proposed trench will be limited <br />to 25 yards in length. However, the total length of the trench will be 100 yards. The <br />Applicant should be aware that the Division does not allow for phased bonding on <br />prospecting operations. In other words, the Division must bond for total disturbance <br />associated with the trench (10,000 cy). The Division has performed a preliminary bond <br />calculation based on the total disturbance and has determined the required financial warranty <br />will likely exceed the $4,000.00 which the Applicant has already posted. Alternately, the <br />Applicant may reduce the proposed length of the trench to limit the amount of bond which <br />must be posted. A modification to the NOI may be filed at any time to increase the length of <br />the trench and additional bond may be posted at that time. Please respond. <br />6. The Applicant has stated that berms will be replaced on the roads during final reclamation of <br />the site. In addition, the Division requires that the Applicant establish vegetation on the <br />reclaimed road. Please commit to seeding and mulching the road in the same manner as the <br />rest of the site. <br />Be advised that if these items have not been addressed within 60 days of the date of this letter <br />(October 13, 2014), the Division may terminate the NOI application in accordance with Rule <br />5.1.3(c) of the Hard Rock Rules. <br />Please remember to designate as appropriate those materials in the application that you desire to <br />be made confidential versus those to be made public.
