COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />September 4, 2014 <br />Robert Tibbetts <br />The Denver Brick Company <br />401 Prairie Hawk Dr. <br />Castle Rock, CO 80109 <br />RE: Stevens Clay Lease, DRMS Permit No. M- 1996 -064 <br />Technical Revision 3, TR -03 <br />Preliminary Adequacy Review <br />Dear Mr. Tibbetts: <br />The Division of Reclamation, Mining and Safety (DRMS) has completed a review of Technical Revision number <br />3, and has the following comment: <br />DRMS understands the Operator plans to disturb phases 1, 2, and 3 concurrently, while performing <br />mining and reclamation activities. Therefore the Operator is requesting an increase to the maximum <br />allowed disturbance at one time from 10 acres to 20.8 acres. However the current approved reclamation <br />cost estimate (6.4.12 Exhibit L Reclamation Cost) submitted with the original permit application <br />(enclosed), only accounts for reclaiming 10 acres at a time. Please provide a reclamation cost estimate <br />for the new proposed maximum allowed disturbance of 20.8 acres. The estimate shall contain all <br />information necessary to calculate the costs of reclamation and must be broken down into the various <br />major phases of reclamation. The information provided by the Operator must be sufficient to calculate <br />the cost of reclamation that would be incurred by the state. <br />The current decision deadline for this technical revision is September 17, 2014. Please provide responses to the <br />above comments soon enough for the Division to review the responses and complete a follow -up exchange of <br />comments and responses prior to the decision deadline. If you are unable to provide satisfactory responses to any <br />inadequacies prior to the decision deadline, it will be your responsibility to request an extension of time to <br />allow for continued review of this application.
