energy fuels coal, inc. <br />southfield mine • post office box 459 • florence, colorado 81226 • (719) 784 -6395 <br />July 15, 2014 <br />Rocky Mountain Fuel Company <br />91015 1h Street <br />Denver, CO 80204 <br />RE: Vegetation Reference Area Relocation <br />Energy Fuels former Coal Loadout Site one mile west of Florence, CO. <br />Dear Rocky Mountain Fuel: <br />Rocky Mountain Fuel is listed with the Fremont County assessor as the subsurface minerals <br />owner at the property in Section 17, T19S, R69W, 6th PM. The property is located one mile west of <br />Florence, Colorado on County Road 79 at the Rio Grande /Santa Fe railroad siding. Energy Fuels formerly <br />used the site as a loadout facility to load coal into rail cars — the site was closed and reclaimed in 1979. <br />You may be aware that Energy Fuels Coal, Inc (EFCI) has the reclamation liability at the site and <br />EFCI is in the process of requesting final bond release from the Colorado Division of Reclamation Mining <br />& Safety (CDRMS) to release further reclamation liability. <br />Previously, EFCI had a Vegetation Reference Area located on the east side of the eastern <br />property boundary (the east Loadout). Vegetation Reference Areas are required in an 'undisturbed' area <br />to be used as a reference for the vegetation that has grown on the reclaimed sites for a vegetation <br />comparison basis for success. <br />However, someone disturbed the original vegetation reference area and destroyed the <br />overlying vegetation from that area rendering that site unuseful for vegetation study and comparisons. <br />Consequently, EFCI is required by CDRMS regulations to relocate the vegetation reference area to <br />another 'undisturbed' area. We are enclosing a map of the site(s) for your review where we have <br />selected an undisturbed area to relocate the Vegetation Reference Area. No disturbance or change to <br />the surface is involved with vegetation reference areas, only the vegetation is studied and vegetation <br />samples clipped to be used for comparison to the rest of the Loadout site that has been reclaimed. <br />At the direction of the regulating agency CDRMS, EFCI hereby asks the minerals rights owner, <br />Rocky Mountain Fuel, for a letter of confirmation that Rocky Mountain Fuel currently has no plans to <br />disturb the relocated vegetation reference area (highlighted on enclosed map) for the next year or two. <br />Tentatively, EFCI plans to finish the reclamation requirements during 2014 - 2015 and then request final <br />bond release and release of liability from the Loadout site. Given the typical time involved for the <br />release process with the state, the approval process of the release could carry over into 2015 -2016. <br />
