Summary <br />Permit C- 2010 -08 <br />CAM submitted an application for a new permit on September 22, 2010. The Division issued <br />permit C -2010 -088 for the Fruita Loadout on March 6, 2012. The permit was approved as a coal <br />loadout only and no underground or surface mining will occur within the permit boundary. The <br />Fruita Loadout will be operated by CAM and is located on privately owned lands within Mesa <br />County, Colorado. The legal description of the lands included within the permit area is: <br />Township 1 North, Range 3 West, Ute P.M. <br />Section 2: Portions of the SW /4, W /2SW /4SE /4 <br />Section 3: Portions of the SEA, SEASE /4NE /4 <br />Section 10: Portions of the N /2NE /4 <br />Section 11: Portions of the N /2NW /4, N /2NE /4, SE /4NE /4 <br />The Fruita Loadout permit boundary contains 208.6 acres of land that are all located on private <br />surface. CAM owns 201.3 acres, the Union Pacific Railroad owns 5.3 acres, and Fruita <br />Development LLC owns 2.0 acres. The minerals within the proposed permit area are owned by <br />the respective private surface owners. CAM is approved to disturb 38.1 acres within the permit <br />area. <br />History <br />The Fruita Loadout permit was issued by the Division on March 6, 2012 and was immediately <br />placed in Temporary Cessation. On October 26, 2012 the Division issued final approval for <br />Technical Revision No.I which allowed for the suspension of all water monitoring at the loadout <br />site. Through adverse possession, CAM lost a total of 7 acres of permit area to an adjacent <br />landowner. With the final approval of Technical Revision No.2 on March 18, 2014, the permit <br />boundary was adjusted to its current acreage of 208.6 acres. To the date of this midterm review, <br />no mining related activity or disturbance has occurred at the Fruita Loadout. <br />Description of the Environment <br />The Fruita Loadout is located approximately 3 miles northwest of the city of Fruita and 1.3 miles <br />southeast of the town of Loma, Colorado. The permit area is located north of the Colorado River <br />and is situated between State Highway 6 & 50 and Interstate 70. The permit area is found on <br />USGS Mack, Colo. 7.5 minute topographic map <br />The permit area and adjacent area lie within western Mesa County. Private lands are under the <br />jurisdictions of Mesa County and the city of Fruita. Existing land uses within the permit and <br />adjacent area consist of industrial, agricultural, rangeland, fish and wildlife and a transportation <br />corridor. <br />2 <br />
