to release $87,927.00 of reclamation liability. The remaining bond liability, after the proposed <br />release for SL -5, and as updated for current costs, is $4,929,064.00. Table 1 provides a summary of <br />the bond releases at the Seneca II -W Mine. On the table, "DRMS Costs" is the current bond <br />amount by task as calculated at the time of the first Phase I release (SL -2), "SCC Release Request <br />Amount" is the amount requested by SCC in the SL -5 application, and "DRMS Proposed Release <br />Amount" is the amount the Division is proposing to release with SL -5. Phase II bond release costs <br />are associated with costs for topsoil replacement, reseeding, or maintenance. Costs have been <br />retained for maintenance of the postmining drainage channels, anticipated weed control measures, <br />and reseeding of the mine site as required by Rule 3.03.1(3)(a). Costs associated with the exclusion <br />areas will be retained in the bond. <br />The proposed amount to be released is less than the eighty -five percent of the full required surety <br />prior to any bond releases that could eligible for release under Rule 3.03.1(2) (a). A summary of the <br />original liability amount and all bond releases to date is presented in Table 2. The remaining <br />$4,929,064.00 shall be sufficient to complete all remaining reclamation work at the site if the work <br />had to be performed by the Division, including a reestablishment of vegetation on any revegetated <br />areas, should those areas fail. <br />The Division currently holds a performance bond in the amount of $5,818,456.00 for the Seneca II- <br />W Mine. SCC may reduce the performance bond by $889,392.00 to $4,929,064.00. <br />In conjunction with the SL -5 Bond release review, the Division discovered discrepancies in the <br />DRMS database regarding surface and mineral ownership of lands within the Seneca II -W permit. <br />These values have been corrected on the proposed decision form to bring the Division's database <br />into agreement with the ownership information as described in the approved permit and shown on <br />permit maps Exhibit 3 -1 and Exhibit 3 -2. These corrections include the addition of 85.00 acres <br />State of Colorado surface acreage, a reduction of 40.2 acres federally owned surface, an addition of <br />140 acres of County owned surface (Hayden Public Library), and a reduction of 184.8 acres of <br />privately owned acres. The corrections to mineral ownership include an increase of 198.00 acres of <br />County owned minerals (140.0 acres owned by Hayden Public Library and 58.0 acres owned by <br />Routt County). The county owned mineral acres were previously included in privately owned <br />mineral acres and federally owned mineral acres. In order to correct the Division's database, the <br />privately owned mineral value has been reduced by 124.8 acres, and the federally owned mineral <br />value has been reduced by 73.2 acres. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Steamboat <br />Pilot as soon as possible. Requests for public hearing must be submitted to the Division in writing <br />within thirty days of the first publication in the Steamboat Pilot. If no hearing is requested within <br />those thirty days, the Division's decision will become final. <br />Page 16 of 18 <br />
