PO Box 1150 <br />28755 Hwy #9 <br />Silverthorne, CO 80498 <br />Everist Materials, LLC Phone 970.468.2521 <br />Fax 970.468.2756 <br />August 27, 2014 <br />State of Colorado <br />Division of Reclamation, Mining, and Safety <br />Department of Natural Resources <br />Attn: Eric Scott <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />RE: Permit M 1996 -049 Monitoring Inspection, Corrective Action <br />Dear Eric, <br />Please find the following information addressing the corrective action measures from <br />your July 17, 2014 inspection of the Maryland Creek Ranch Gravel Pit. <br />Financial Warrantv <br />The financial warranty for the process area is not adequate to reclaim the site in <br />accordance with the approved reclamation plan (rangeland). <br />Request: We would like to request a 60 day extension from the August 29, 2014 <br />due date to discuss the industrial/commercial post - mining land use with Summit <br />County with respect to our conditional use permit. Following the 60 days, we will <br />file the appropriate amendment application to reflect an industrial/commercial <br />post - mining land use or increase our bond to account for the process area <br />reclamation. <br />The operator will need to confirm that the exposed surface water on site has been <br />accounted for by the committing of adequate water rights to the State Engineer's Office. <br />Request: Pertinent excerpts from an email from the SEO's office dated October <br />16, 2013 is attached outlining the final items required for exercising the no. 4 <br />approach for exposed surface water. We will be filing the affidavit and would <br />like to request 30 days to finalize this last step. <br />Off -site Damage <br />Land has been affected outside of the approved permit boundary. <br />Corrective Action: Please see the attached photographs of the stockpile <br />relocation, staked permit boundary and reclaimed slope. <br />
