The
required fee of$257 for this SWSP renewal has been received (receipt no. 3665551).
Plan Operation
The Heit Sand and Gravel Mine perimeter was lined with a slurry wall in accordance with the
State Engineer's Lining Criteria, and was approved by the Division Office on June 24, 2009. In
accordance with paragraph 21 of the General Guidelines for Substitute Water Supply Plans for Sand
and Gravel Pits, the applicant is required to provide replacement for all native ground water
remaining within the lined area that is put to beneficial use except for the water removed with the
mined product. The water may be removed from within the lined area and returned to the stream
system through surface flow or ground water recharge without need for replacement, so long as the
operator does not put the water to beneficial use. Replacement shall be made for native ground
water that is lost to evaporation. For purposes of this SWSP, it is assumed that all water within the
lined area is trapped native ground water. Therefore, this plan will account for depletions resulting
from evaporation of exposed water within the lined area. Operational depletions at the site will
consist of water used for dust control and for washing of the mined aggregate using an onsite
production well. All water used from the production well must be replaced in time, place and amount
including water used for washing of mined product. Total depletions for the Heit Sand and Gravel
Mine during the period of this SWSP will be replaced by fully consumable water leased from the City
and County of Broomfield.
In accordance with the letter dated April 30, 2010 from the Colorado Division of Reclamation,
Mining, and Safety("DRMS"), all sand and gravel mining operators must comply with the
requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the
protection of water resources. The April 30, 2010 letter from DRMS required that you provide
information to DRMS to demonstrate you can replace long term injurious stream depletions that
result from mining related exposure of ground water. The DRMS letter identified four approaches to
satisfy this requirement. A surety reduction was approved on March 23, 2010 by DRMS reducing
the bond by$110,614—representing the remaining 20% of the construction bond that was posted
for the slurry wall. The remaining bond of$197,280 remains in place to cover the remainder of the
reclamation plan. With the slurry wall installed and approved by DWR as meeting the State
Engineers lining criteria for gravel pit, the Heit Mine is in compliance with the State Engineer's
requirements pursuant to § 37-90-137(11).
Office of the State Engineer
1313 Sherman Street, Suite 818•Denver,CO 80203•Phone:303-866-3581 •Fax:303-866-3589
www.watenstate.co.us
