Rob Quint <br /> August 22, 2014 <br /> Page 2 of 3 <br /> 6.4 SPECIFIC EXHIBIT REQUIREMENTS—REGULAR 112 OPERATIONS <br /> The following items must be addressed by the applicant in order to satisfy the requirements of C.R.S. 34-32.5-101 <br /> et seg. and the Mineral Rules and Regulations of the Mined Land Reclamation Board: <br /> 6.4.1 Exhibit A—Le2al Description <br /> 5. As required by Rule 6.2.1, all maps must be prepared and signed by a registered land surveyor,professional <br /> engineer, or other qualified person. Please sign the maps submitted in Exhibit A(with the Clerk and Recorder <br /> page numbers 10 and 47). <br /> 6.4.2 Exhibit B—Index Map <br /> 6. As required by Rule 6.2.1, all maps must be prepared and signed by a registered land surveyor,professional <br /> engineer, or other qualified person. Please sign the map submitted in Exhibit B (with the Clerk and Recorder <br /> page number 14). <br /> 6.4.5 Exhibit E—Reclamation Plan <br /> 7. Section A. of the reclamation plans states: "Overburden will be replaced when there is a sufficient area <br /> affected(3-5 acres)and it will not disrupt mining operations. (See Mining Map)". Since no mining will occur, <br /> because this amendment involves only adding acreage to reclaim the site,please revise this statement to <br /> "Overburden will be replaced". <br /> 8. To be acceptable to the Division,please revise section B. of the reclamation plan to state"any slopes created <br /> will be graded no steeper than 3h:ly,unless approved by the Division". <br /> 9. Please replace"20.13 acres"with"32.25 acres"in section M. of the reclamation plan. <br /> 10. During the pre-operation inspection conducted on August 19, 2014,the Division observed a dry creek bed of <br /> an ephemeral drainage along the northeast boundary of the site. Please describe in detail the reclamation <br /> proposed for this area as compared to the rest of the site. <br /> 6.4.6 Exhibit F—Reclamation Plan Map <br /> 11. This map shall indicate the expected physical appearance of the area of the affected land, correlated to the <br /> proposed reclamation plan.The map must show proposed topography of the area with contour lines of <br /> sufficient detail to portray the direction and rate of slope of all reclaimed lands. <br /> 12. Please indicate where the dry creek bed, as mentioned above, is located. <br /> 6.4.13 Exhibit M—Other Permits and Licenses <br /> 13. Based on the pre-operational inspection,the Division noted that the proposed reclamation activities could cause a <br /> potential for offsite impacts; it was observed that the mine site is uphill of an ephemeral drainage. Due to topography, <br /> there could be a potential for the transport of sediment down into this drainage during a storm event. Please commit to <br /> pursuing a Stormwater Discharge Permit. Please contact the Water Quality Control Division of the Colorado <br /> Department of Public Health and Environment(CDPHE) for further information regarding this permit. <br />
