Boulay <br />Division Of Reclamation, Mining & Safety <br />rd <br />101 South 3 Street, Suite 301 <br />Grand Junction, CO 81501 <br />Re:RoadsidePortalsMineSL-08,ProposedDecisionAndFindingsOfComplianceFor <br />BondRelease Application; Comments On Behalf Of Jason Carey <br />Dear Mr. Boulay: <br />AslegalcounselforJasonP.Carey,wearesubmittingourcommentsontheproposed <br />decisionandfindingreferredtoabove.Wehavereviewedtheproposedfindingsand <br />appreciatetheopportunitytoexpressourconcerns,whichareserious.Asyouknow,there <br />havebeendischargesfromtheSouthPortalwhichhavecausedachangeintheCDPHE <br />permittoincludeminewaterdischargeandapotentialpublicemergencyaswellas <br />damagetoourpropertyandusethereof.TherealsoremainsubsidenceissuesontheCarey <br />andFontaneriProperties.Asfaraswecandetermine,theareasofthosepropertiesaffected <br />by discharges and subsidence are included within the areas proposed to be released from <br />reclamation bonding. <br />ThereareproblemswithAttachment5,whichneedsberevisedtoprovideaclearer <br />depiction of properties affected by the bondrelease.The Carey Property is not identified <br />onAttachment5even though a portion of that property is within the area covered by the <br />proposedpartialbondrelease.Apreviousmap, designed on July 17, 2014andwhichyou <br />furnishedus,dididentifytheCareyPropertyandshowedwherethereleasedproperty <br />would overlay the Carey Property. <br />Inaddition,thesameAttachment5doesnotadequatelyshowtheareaoftherefusepileand <br />itslocationinrelationtotheCareyProperty.Wearenotabletodeterminefromthis <br />attachment,oranyotherattachmentforthatmatter,theextentofreclamationbonding <br />beingeliminatedfromeitheranareaorfinancialbasis.Giventhedischargeissuesandthe <br />subsidenceissueswhichhaveaffectedour property, we wouldrequestthat the amount of <br />thepartialbondreleasebereducedbyatleastthirty-threeandone-thirdpercent(33-1/3%). <br />Weareentitledtothecontinuedprotectionofthereclamationbondevenonareas, <br />particularlytheFontaneriProperty,wheretherearesubsidenceanddrainageissueswhich <br />have a direct impact upon our property. <br />Theproposedfindingsdonot addressthe need for an increasedreclamationbondto deal <br />withthenecessaryrepairswhichwillhavetobemadetoadequatelydealwithpotential <br />waterdischargefromtheSouthPortalandacrosstheCareyProperty.Wehadunderstood <br />
