Compliance With Mine Plan <br />NA - Support Facilities Not On -site <br />NA - Other <br />NA - Special Categories Of Mining <br />NA - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a partial coal inspection conducted by Jason Musick of the Colorado Division of Reclamation, Mining, <br />and Safety (Division) on 13 August 2014. The purpose of this inspection was to evaluate the on- the - ground <br />condition with respect to Seneca II Mine's Phase III (SL -6) bond release application, in accordance with Rule <br />3.03.2(2). The inspection was attended by the following: <br />Vern Pfannenstiel of Peabody Energy <br />Roy Karo of Peabody Energy <br />Scott Cowman of Peabody Energy <br />Phillip Courtney of the Colorado State Land Board (Landowner) <br />Jerod Smith of the Colorado State Land Board (Landowner) <br />The weather was clear and the ground was dry during the on- the - ground inspection of the site. All areas to be <br />inspected were accessible and visible. <br />Lands requested for liability release and termination of jurisdiction under SL -6 include 271.2 acres of land <br />revegetated from 1997 to 2003. Surface land ownership is private (State). Sub - surface ownership is private <br />(State). Representatives from the Office of Surface Mining and the Bureau of Land Management were notified <br />with OSM accompanying the inspection and BLM declining to attend. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The five permanent v -notch contour ditches are stable and functioning as designed. No erosion or gully features <br />were noted in or around v -notch ditches at the time of the inspection.
