Custer Counttj Conservation District
10 Hermit Lane
P.O. Box 389
Westcliffe, CO 81252
719-783-2481
August 19, 2014
Mr. O'Donnell,
r
In reference to the Edward M. Yaklich, Shangri la Pit, permit number M - 1989 -024.
The Custer County Conservation District is concerned with the request for the release of this
Reclamation Permit. Because there has never been any excavation at this site. It would stand to reason
that a permit is no longer necessary, but the District is unaware of any action that would return the
augmented water back to its original beneficial use, which was irrigation of the land where the
Reclamation Permit was located. Based on this fact, the District is concerned that excavation of some
type could still occur without the oversight and technical expertise of the Division of Reclamation.
If the Division of reclamation can assure the District that no excavation can legally occur without Division
oversight and further assure the District that should any illegal excavation occur that it would not
become the financial responsibility of the District to effect a cure, the District would discontinue its
V' °bi e ction•
Thank you for your consideration.
Custer County Conservation District
14
Helping People Manage Their Resources
www.custercountyconservationdistrict.org
